I filed my FSW in May 2011. Few days back I got a request for updated forms with the job offer letter ( I applied under arranged employment). My LOM was rejected in November so I am on study permit now. What should I do? Send the documents or let them review the file with old documents? The officer emailed if I don't send the documents they will review it based on the info they have and the file might get refused? I heard I should be on work permit when FSW is issued. My previous employer will still be ready to offer me an employment. Can anyone please advise?

If i may ask, who is your case worker (i mean his number-usually you will attention your documents to that number)
If i may answer your question, someone in this forum was in your shoes and i will recommend what he did. He went back to the former employer and he was issued a letter stating his duties and role when he worked with the company and they added this clause that: they are willing to employ him again if his application for PR is granted.

That person in this forum has the same case officer as yours. Regarding your work permit, as at now that you have a pending application, you can apply for a bridging open work permit which is usually 1 year. I guess that will not meet the 30 days ultimatum and since you are a student, you need a student permit to be in school. I will advice you present what you have and leave the rest.
 
hi AK, my work permit expired last year august... do u think i can still apply for bridging work permit?
 
Just send all the requested forms to CIC with a employment offer letter from your previous employer stating that you will be hired on permanent, full time and indeterminate basis after getting PR. This would work in your case. There is no issue in holding a study permit, but try to get the letter of employment for sure. Thanks

Yes you can if you want to, I have read several posts on this forum that had their permit expired before the bridging open work permit was introduced, and they applied after been on student visa and they got it (as long as you have a pending PR application that has received a positive eligibility). The only challenge i see in your case is that you have to submit the documents to DB00204 – CPP-O 30 DAYS from the day the updated document mail was received by yourself.If you apply for open work permit now, (as it takes an average of 5 weeks to process) will you be able to meet up with the submission deadline of 30 days? My advice as i said earlier is to apply with your study permit and the letter from employer together with other forms requested. ALL THE BEST!
