Hi all,

I sponsered my parents and my two brothers in 2004 from India. My younger brother has cerebral palsy but his condition is not bad like some of the other people you might see with the same condition. He can eat and bath himself, helps around the house with chores, can ride a bycycle, can drive a tractor, knows everything about TV and movies and so on. He knows who is who as far relations and is socially very developed comparing to other patients with the same condition.

My family had their interview and medical done towards the end of 2009. The interview officer really liked my brother and asked couple of questions through the translator to which he answered correctly. When they received their medical, my brother was asked to go through the special medical that is designed for people with that condition which means he had to go through an IQ test.

While going through the IQ test he got nervous and messed up on couple of things. So the neurologist gave him an IQ of 40 which was very low for him and I think unfare considering he only messed up on couple of things.

Towards the end of April 2010, my parents received this letter saying my family might be inadmissible on health grounds unless we can provide immigration with our individualized plan to provide him with social services the immigration thinks he will require and our ability and intent to bear the financial costs related to those social services. The social services recommended are special education to improve life skills, independence training, assistive technology and additional community support; occupational therapy, respite care services and long term care facility services.

Tell you the truth my brother really doesn't need any of these services as he knows how to behave in society, he wouldn't need to work so no occupational therapy needed. We have always taken care of him ourselves because it gives us the satisfaction that he is being cared for the best so no respite or long term care facility needed. But even if we have to use any of these services, we are very financially sound so we wouldn't have any problem.

We were just about to write the letter to the immigration explaning all this and our intent to bear all financial costs that I thought I should consult a lawyer here just for a second opinion. What he told me was a big shock to me. He told me that even if you tell immigration that you will take care of providing all these services to him, there is a chance of greater than 90% that immigration will refuse his case. But then you appeal it and you will win 99%. I was shocked again thinking why would immigration waste their time and money and our time and money only benefiting the lawyer who we will hire and who is charging over $10k for the response to the letter and the appeal. Isn't it something that immigration should avoid to the best possible extent. The only person wins here is the lawyer who will make a big chunk of money and spend it on his luxuries while the immigration and my family will waste time and money.

At the end, just want to ask, has anybody else has similar kind of experience. If yes, what is your opinion in regards to this. Also if senior members (Leon and PMM) have any information that will help me with this, please feel free to share. I would greatly appreciate any help I could get.

I can't tell you the odds of getting refused or winning an appeal in a case like this but it seems to me that your lawyer may have his own interests in mind. If he doesn't work very hard on helping you with your plan for your brother, then you have increased odds of being refused and then he can collect your money to make an appeal. Maybe you should talk to another lawyer.

recommend you seek opionions from another two lawyers and then make an informed decision

i spoke to an immigration lawyer, he gave me advice, i took it and regreted it
in the end i went it alone and suceeded

Whilst these threads deal with autism/aspergers syndrom, the explanation about excessive demand and the things you will need to do to overcome them are the same.

There was a case in law (see the cic website reference for details) that shows you what they require.

Finally, here is a bulletin on "excessive demand" with full details of what they are looking for and the procedures used. I would suggest carefully reading the case law specified as it details what you will need to do prove your ability to take care of him.

Basically you will need to prove, both in statements/affidavits and in showing financial ability to pay for his upkeep, that he will not be a burden on the canadian system.

Just talked a lawyer referred by a friend and I was quoted about 10k to be represented during the Appeal process. Such a lot of money and it does not even guanrentee a positive result:(

I would really appreciate if someone who has been through this process to share valuable info with me. THANK YOU!

Hello there,

Sorry, I didn't see your post earlier. I rarely come on this forum now. It is kind of depressing. Well our case didn't go that well. We wrote two letters to immigration in response to the letter my parents received regarding my brother's condition. One was from my Dad and another one from me. We told them that we will take care of any of the costs related to the social and occupational services he needs. We also told them that he would not need respite care or long term care facility as we will take care of him. I told them in my letter that I get four weeks of vacation and also can bank my overtime in order to take extra time off so there will be no problem with taking care of my brother.

But immigration people at Delhi office didn't believe us. They went ahead and rejected our application. We later appealed this decision. When we got the blue book I was shock and disgusted at some of the assumptions they had made in order to reject our case. I was full of anger as none of them was true.

To make it worse, my brother who had CP had an epilepsy seizure in Feb 2011. He survived that one but later had another one in March 2011 which he couldn't survive. We are devestated. My brother is gone. It will be one year on March 18. The pain of losing him is so bad. We miss him more and more everyday. I wish he could have gotten here because he wanted it so much. More than that I think he would still be alive today if he was here because we have such a good medical system here. It took us more than four hours to get him to the hospital in India. Becasue the closest neuro hospital was 60 km away. The damage was done by the time we got to the hospital.

I am sorry for writing so much. My advice to you would be to write your letter with the help of a lawyer who is good with cases like this. I had emailed CPABC association here in BC and the lady over there told me she would put me in contact of a lawyer who could help me with this. So please seek advice of a good immigration lawyer who has good experience with cases like this.

I am so so sorry to hear that Sping. I can imamgine the pain in your heart and don't even know what I could say to help.

With regard to my case, we worked with a lawyer and have submitted the documents for CIC to review. By the sound of it, we will be rejected too. Not much can be done:(
