Hello guys. I'm new to the forum. I found it on the net while i was browsing. :)

I have a situation and would appreciate it greatly if someone could provide some information as it relates to my case.

I'm a Jamaican citizen age 19, attending university doing a bachelors which will end in 2013-2014.
I live with my mom and she is the one that finances me through school and etc. So am fully dependent on her.

I have a sister in Canada. Toronto, Ontario who is a citizen there..her income is about 450000-50000 per year.

She wants to file or sponsor my mother to Canada. Can i be sponsored as well?

Thanks :)

Who can be sponsored to CANADA?
You can sponsor:
•parents
•grandparents
•brothers or sisters, nephews or nieces, granddaughters or grandsons who are orphaned, under 18 years of age and not married or in a common-law relationship
•another relative of any age or relationship but only under specific conditions (see Note below)
•accompanying relatives of the above (for example, spouse, partner and dependent children).

Sorry kid, unfortunately, your sister cannot sponsor you to Canada. Once you graduate from school and work for upto a year, you might qualify to apply under the Federal Skill worker class and get extra point for having a sister and/or mom in Canada.

No, you are over the age of 18, so you are not a dependent according to Canadian laws
Not true. He would considered a dependent child of the mother who is the principal applicant. The CIC website means those relatives who are ORPHANED and under 18 who would be the Principal Applicant.

OP Manual 2:

Page 15 - Regarding Parental sponsorships

5.13. Who qualifies as a dependent child?
R2 and Section 6 in this chapter describe who qualifies as a dependent child.
In order to meet R2(b)(i) of the definition of “dependent child”, a child must be under 22 years of
age and not a spouse or common-law partner on the date when the IMM 1344AE is received by
CPC-M, and not a spouse or common-law partner when the visa is issued, and when they arrive
in Canada.

Not a spouse or common-law partner means that the dependent child must not be married or
involved in a common-law relationship. A dependent child who is single, divorced, widowed, or
whose marriage has been annulled is not a spouse. Similarly, if the dependent child was involved
in a common-law relationship but that relationship no longer exists, they may be considered to
meet the definition.
R2(b)(ii) & (iii) describe children over the age of 22 who may be considered dependent children if
they are substantially dependent on their parents for financial support. This includes full-time
students enrolled in accredited post secondary institutions or children with a physical or mental
condition. In such cases, officers must ask for documentary evidence of full time attendance at
school, evidence of the institution's accreditation with the relevant authority, evidence of the
physical or mental condition and evidence of financial dependency on parents.

You mom case will take about 5-6 years. And after that time period you wont be dependent any more. You may be considered as a dependent at this time, as per of your student status as full-time. But Canadian embassy also looks at the individual's age at the time of issuing permanent resident visa.

Unfortunately, you will not qualify at that time.

No, that's not true either.

His age will be locked in at the time the application is made.

OP Manual 2 - Page 8

5.4. Lock-in age of dependent children
The lock-in of age for dependent children is the day CPC-M receives a completed IMM 1344AE
and correct processing fees. Dependent children must be less than 22 years of age when the
sponsorship application is received.

Under 22 years means up to and including the last day before the dependent child's 22nd
birthday.
Offices must date-stamp application forms as soon as they are received.

Wow! Great responses and so fast :)

I thank all of you guys for your time and answers - rjessome, adzees, Canuky.

Now am crystal clear on the dependent child part.
So whenever the application is received and processed this will take some time for it to be finalized..So would i have to leave along
with her? I'm wondering how long will this take for both of us.

Would we need to be out of the country(Canada) during this process?

Can i be referred to a site or could one of u experts provide me with the requirements for my sis, my mom and I ?

No, you don't need to be out of the country to apply. Here's where you start:

http://www.cic.gc.ca/english/immigrate/sponsor/relatives.asp

You should read the relevant sections of the Processing manual which can be found here:

http://www.cic.gc.ca/english/resources/manuals/op/index.asp - You want OP 2

LOL jillandmatt. Somedays I think I just make people angry because I don't tell them what they want to hear or I disagree with them. :( But all the negative karma is worth it if people avoid mistakes.

Yes, you can sponsor your mother as a PR as long as you meet the financial eligibility requirements.
