Canada needs to select immigrants who are ready, willing and able to fully integrate into Canada's labour market and fill gaps in our economy, particularly where we have existing skills shortages.

Q2. Would I be affected if CIC removes the FSW backlog?

Under the proposed changes, CIC would close Federal Skilled Worker applicants' files if they:

applied before February 27, 2008, and
have not had a decision made by an immigration officer based on selection criteria by March 29, 2012. (information on selection criteria is below)

We expect this would affect around 280,000 people including dependents.

If the proposed law is passed, CIC would begin to return the full amount of fees paid by affected FSW applicants.

Q3. Is there any reason I would not get my refund?

The proposed changes are intended to be retroactive to March 29, 2012. If an immigration officer had refused your application based on selection criteria before that date, you will not get a refund.

Q4. What does a "decision based on selection criteria" mean?

A "decision based on selection criteria" means that an immigration officer:

has assessed your FSW application against the points grid, and
has made a decision on whether or not you meet the selection criteria of the program.

Currently, the pass mark is 67 points out of a grid worth 100 points. The grid considers the person's:

ability in English and/or French
education
work experience
age
whether they have a job already arranged in Canada (arranged employment), and
how well they might adapt to living in Canada (which awards points for things like previous work or study in Canada, spouse's education and relatives in Canada).

If your application is successful, you would move to the next phase (i.e. admissibility). At that point you would be checked against health, security and criminality requirements before being allowed to enter Canada.

If you do not score at least 67 on the FSW points grid, your application would be refused and CIC would inform you of the decision.

Q5. How would I get my refund?

More details on the proposed change will be announced soon. Once the proposal is approved through Parliament, CIC will begin to return the fees.

Q6. What options would I have if my application is removed from the backlog?

If your file is closed by CIC, you may re-apply under the current FSW criteria. If you have the skills Canada needs now, your application would likely be processed much faster – new FSW applications are processed within 6-12 months.

Very good information, so if you have been given medical request, you are definitely not among the 280,000 people. But this is harsh and too sudden

I do not think you will be refunded. If we have to go by the cic home page

Hello Everybody,

WE need to collectively raise our voice against this injustice.
We can do it,as of now it is just a proposal at the moment.
This needs to be validated at the parliament soon... as per the below quoted lines...

We should not sit and discuss this but find ways so that our voice / cries should be felt in the parliament
and a harsh decisions should be stopped before it is imposed on us...

A thought but the Government will not listen to you. The harsh reality of politics is that you are not in Canada and you don't vote, so the politicians don't care.

Just one clarification:

Those who have filed through agents or consultants and heve even paid post landing service charges, what will happen to their fee. will agents return this amount to clients. In my view Clients have evry right to appeal in indian court against the agent and cic will definitely become a party to it. This will bering insult for cic and media will definitely exploit this situation. And I expect and hope lot of litigations will be filed in indian court and I am one of them. I have already consulted my advocate and case can be filed in india in such a scenerio and may bering relief to clients in returning money in addition adverse remarks to cic.

No. This effects only those FSW-applications submited prior to feb. 27 2008.

a decision has been made that your application meets the selection criteria ie paper selection decision 01=pass

you now move on to the next stage ie selection decision when medicals are issued

you are among the 20,000 exempt from the axe

the wording of the text says that you "meet the selection criteria of the program" and it does not say a positive selection decision (SELDEC on caips) has been made on your application

when the immigration officer assesses your file allots points for the qualifying criteria and gives you a pass ie paper screening decision PSDEC=01 you meet the selection criteria

my above analysis is also based on my understanding of "refunds policy" cic was following until now ie if the visa officer has assessed your file ie points awarded and a decison made that you qualify or not by meeting the 67 threshold you are not entitled to a refund

also the last line in the FAQ further clarifies the situation

Currently, the pass mark is 67 points out of a grid worth 100 points. [....] If you do not score at least 67 on the FSW points grid, your application would be refused and CIC would inform you of the decision.

and in the above case also no refunds are given

however i would welcome contrary views on the issue

Dear In my caips ,the total points were alloted and even ielts results have been varified online. also paper selection is passed and medical forms are ready to be issued with all the details. this means every thing has been done on my file but issuance of medicals were held due to new occupation list in action.I am also sure that VO has assessed my file upto the final stage and could have sent the medicals but it was not. The things will be clear in coming few days with lot of clarifications coming from consultants, experts ,media and cic itself.

I am writing to you this letter to complain and ask for help .I am among the thousands of oppressed people who applied for emigration as a FSW by 2008 and will destroy their lives and their dreams in the case of approval of the closure of their files in this unfair step.

In the beginning, the most important reasons for our choice of immigration to Canada is our belief as a country dominated by the values ​​of justice, equality and a human rights. and we sacrificed with a lot of effort and money and time in order to prepare our files, hoping to start a new life and future for us and for our children in Canada, and we accept to wait until completion of the thousands of files, which made for Migration after us years as if we were punished on the speed of our sponsorship immigration applications and then be surprised, after waiting for more than 6 years of the Government's decision to slash our files without the slightest sense of responsibility for the destruction of the lives of thousands of families by this unfair decision , which reflects definitely the absence of respecting our humanity and our rights of dealing with our files equally like others, and without respect to the agreement between us and the government ,I ask you to imagine how much damage the physical and psychological effect on us and our families from the destruction of our lives and the loss of many opportunities and effort and years waiting for the start of our lives in Canada, what can make up all of that ?and is it required from us to start again after the loss of all these years ? the law may pass by the strong majority in the government, but how to pass from the punishment of God for the injustice and the destruction of the lives of these families, I hope you can help us in the delivery of our voices to all shades of Canadian society and I am sure that such a decision gives voice about the value and harm the reputation of Canada's more than good and we are ready to provide any additional guarantees or wait until the processing our files until 2017, but please do not damage our lives and the lives of our children by this tough and unfair decision.
