Hi,
So I am a little confuse of what path of immigration is the best from American citizen who want to move to Canada. My boyfriend is American and we been doing long distance for 5 years so we would like for him to move soon. He has only 8 months of work experience right now but graduating in may so we will continue to accumulate experience. However, if we apply now for a work visa it seems like he would not be considered because to little experience. So we were looking for spouse sponsorship, looks like a common process. I was wondering if we could get a work visas through the sponsorship because being in Canada and not working is not an option. Also I will be doing my master while we apply for immigration so I have a stable income but not comparable to the salary of a full time job. Can that be an issue? Also I live in Quebec right now but sponsorship since easier in Ontario, should I think about moving ?

I'm assuming you are Canadian? If so, then yes, you can sponsor him for permanent residency as your spouse after you get married. If he comes to Canada and you spouse him as your spouse from insdie of Canada, then you can include an open work permit application with that sponsorship application. However you should be prepared that it may take 8 months for the open work permit to be approved - meaning that he would need to be prepared to live in Canada for at least 8 months without working. There are no minimum income requirements to sponsor a spouse.

Getting a work permit independently (without you sponsoring him for PR) would require him to secure a job offer with an employer in Canada and for that employer to most likely obtain an approved LMIA. Your BF could then apply for a closed work permit tied to that specific employer. It can be quite difficult to find Canadian employers willing to go through this process - however that can also depend and be influence by what your boyfriend studied and his work experience.

If you are doing a masters and attending courses in person you’ll need to apply to sponsor in the province where you are living.

Thank you for all this informations. So if I understand probably with cant do the spouse sponsorship if we are not married ? And this application can’t be Outland, it needs to be done inside Canada?

Right now you do not qualify to sponsor him. You either need to get married OR you need to live together continuously for one full year to become common law. You can't sponsor him until you do one of these two things.

The application can be outland, however then he won't qualify for an open work permit. But yes, an option (once you are either married or common law) is to sponsor him outland.
