Hey Guys

I have two quick questions. My work permit expired on July 1, 2016 and I applied via paper application for a Bridging Open Work Permit shortly before then. I received a refusal letter in October 13 detailing I need to be in process of PR for the BOWP and that I have 90 days to restore my status. My questions are:

a) Does my 90 days to restore my status start on July 1 my initial work permit expiration or October 13 when I got the refusal letter and lost implied status?

b) I've received an ITA and applied for PR in November. So far, I've received my AOR but my eligibility is still in review (i.e. haven't passed R10 completeness check). Can I apply for the Bridging Open Work Permit with the first AOR when I submitted my PR application or do I need to wait for the R10 completeness check?

I think it depends on if they refused your application or rejected it as incomplete. If they rejected it, 90 days count from the expiriy date of your original visa. If it's been refused, it might be counted from the date of the refusal letter. Please ask other members' opinion too on this ...

1st AOR would be sufficient, however, you have to have a valid work visa in order to apply for BOWP, so unfortunately you are not eligible for it anymore.

It sounds like you're in luck (sort of), your 90 days starts on the date of your refusal.

You are no longer eligible for a BOWP. To be eligible, you have to have a valid work permit - you no longer do. So, you cannot apply to "restore" to a BOWP. You could apply to restore as a visitor, if you are not eligible for other work permits (meaning, if you do not have an LMIA, etc.).

Hi Guys,

i am currently in Express Entry pool with 476 points ,my PGWP will expire on 22 Dec this year .
i am expecting ITA soon ,if i don't receive the AOR before the expiry date of my WP,how can i apply for BOWP !!
I am still working full time with a company and they need a proof for work permit extension.
what options do i have !!!

Short answer - you can't. But, if you get the ITA, are you ready to submit your application, do you have all your supporting documents?

They can apply for an LMIA, or you can check and see if you are eligible for other types of work permits. What is your country of citizenship, and how old are you?

i don't think that i am eligible for other types of wp,31 years old ,venezuelian

what if i send the BOWP application by paper without AOR in case i didn't receive it before the expiry date!!!
 
If you submit your PR application the first automatic AOR is sufficient to apply for BOWP. There is no need to wait for 2nd AOR anymore. So, if you can get your ITA before dec. 22, submit your application really quickly. It would worth to prepare your BOWP application as well.

You usually receive the AOR email within 24 hours of submitting your application. Once you get that, you can apply for the BOWP. You will then be on "implied status" after your current work permit expires, until you receive a reply on your BOWP application. Your BOWP application cannot be approved unless/until your application passes the completeness check. If your application is deemed incomplete, your application will be returned and your BOWP denied, so make sure you submit a complete application.

This explains "implied status." Some employers don't understand, so you can show them this.
