BOWP - How many of you have applied and received it successfully?

Not Correct, it says You should be in Canada at the time of BOWP application not necessarily saying BOWP is "In Process".
Simply meaning You can apply BOWP only from within Canada, if you are outside you cannot apply BOWP>

Not sure how that contradicts what I said. In process means the entire time between when you submit the thing and when it gets approved. So of course you need to be in Canada to submit it.

What the poster had said was to not leave and re-enter Canada at any point before applying for the BOWP, which I could see no problem with.

Example: If you apply today for BOWP and go to New York on weekend and come back - it does not not affect your application.

You could probably get away with it, but OB485A does technically say that they will check that you're in Canada. I don't know how they would do this as I never even got a phone call. But it is probably safer not to leave while it's in process.

Given the processing times are so short now (for online apps anyway) it shouldn't be that hard to wait.

No. That's fine. They will check your UCI number for the AOR.

I just called CIC and was told that my BOWP was sent out yesterday. My immigration lawyer submitted the paper application on Sep 27 with my new job offer, and my current WP won't expire until Aug 2014. I was reading this forum and thought my application might be refused... Looking forward to the new job :D

You are the person I am looking for very long, I mean the one who got his BOWP with more than 4 months validity and applied after 19th Sept, 2013. This is awesome news. I can still keep my hopes alive. Thanks a lot for the update and congrats once again.

Thanks, Kunishsa. I was reading this thread and found many refusals with WP > 4 months. In OB485A they talk about the people who are not eligible for BOWP: "Foreign nationals whose work permits are valid for longer than four months and/or already have a new LMO that can be used as the basis for new work permit application."

I don't particularly understand the part after "and/or": it doesn't seem to be needed if they want to refuse everyone with WP > 4 months... It looks like they are approving people with new job offer but no new LMO for it...

What that means is, that in case you already have a positive LMO from HRSDC you don't qualify for a BOWP, as you can
use that LMO to apply for a closed WP.

It means that one does not qualify for a BOWP if either condition is true, or both. They should have listed the LMO part as a separate bullet point.

A few people on here on closed WPs have obtained a new positive LMO, and then later discovered that the BOWP exists. It's understandable that they would want to 'upgrade' to the open work permit, perhaps for career reasons.

The idea that a "job offer without an LMO" would persuade them to bend the four-month rule is interesting. I assume that you have to apply so early because your contract with your employer has ended. If you're on a closed permit for a specific employer, how could a different employer even make a job offer in good faith without obtaining an LMO?

Thanks for the reply. I too had applied with an offer letter and good explanation letter. It is been 18 days already and there is no update yet. I had applied online. Fingers crossed.

Well, this is kind of a long story from the negotiation process. Apparently this company hasn't recruited any foreign nationals in the LMO era, and HSDRC (or w/e its name is) scared them away by asking for 15 different things when they called them. So they'd rather wait a few months to let me get my WP than do the LMO themselves. My current employment isn't quite ending, but the new job looks a lot better :)

You can try to call them to inquire your application status. That's what I did when I decided to get the good news or bad news, so I could prepare either way.
