Hi Experts,

I currently have a CEC-PR Application under process and I have received an AOR number. My wife works in Canada on Closed WP and I am currently working on SOWP. For the PR application, I am the primary applicant.

My questions are -

1. Can we both (me and my wife) apply for BOWP once our WP is expiring within 4 months? My concern is my AOR does not have my wife's name listed in the email. Will it cause any issue in BOWP for her?

2. Our WP is expiring in Nov-2014. If my wife resigns from her current job today, will she be eligible for BOWP right away as she can not work for any other employer with the closed work permit.

Any help is appreciated.

Does that means that my spouse wont be able to apply for BOWP if I apply? And I am principal aplicant, but we both have work permits that are about to expire.

Depends on which category you have applied for PR. Below is the information from the link Hop1957 shared.


Spouse or Common-law Partner and Dependents
Certain conditions are required to be met by the holder of a Bridging WP, in order for their spouse to also be eligible for an open WP under R205(c)(ii).

In all cases the Bridging WP must be valid for longer than 6 months.

For spouses of Federal Skilled Worker Class applicants: the Bridging WP holder must be performing work which is at a level that falls within National Occupational Classification (NOC) Skill Levels 0, A or B.

For spouses of PNP applicants: the spouse is eligible for an open WP for the duration of the WP held by the principal PNP applicant, irrespective of the skill level of the principal PN applicant’s occupation.

For spouses of Federal Skilled Trades applicants: the Bridging WP holder must be performing work which is within one of the qualifying occupations in NOC Skill Level B.

For spouses of CEC applicants: there are no set preconditions to be met by the principal CEC applicant.

For Dependent children of a PR applicant in any of these Economic Classes, must obtain a LMO or have a LMO exemption based on their specific situation in order to apply for a WP.

Because I guess that I should have BOWP before my spouse apply, or am I'm wrong?

I guess you can both can apply at the same time but attach a written justification with the application. That should help.

ONLY the Principal Applicant is eligible for a BOWP. Your wife would be eligible for a SOWP on the basis of your BOWP, and you can submit the two applications at the same time. Unfortunately, you'll have to wait until you are within 4 months of the expiry of your current work permits.
