But if I change my status to visitor, it will be after my current work permit has expired and then I will perhaps have my AOR, but I won't have the other criteria anymore: a valid work permit at the moment of application.

But I won't be staying illegally if I am on implied status. The CIC agent said it would indeed be legal and I am allowed to stay and work, but he couldn't guarantee that my application would go through. So it'd only buy me time.

Hi LCM,

What is the Worst case scenario in both options?

1 - if you apply Visitor Visa - you will loose your WP status and will have to stop working. Plus, the visitor visa will be for 6 months only. The CEC application will take longer. So in the end you will have to go home after 6 months.

2 - If you apply for BOWP now without your AOR - As Cruiser is saying and as one person has already send the application, write a cover letter explaining when you sent in your CEC application. This will tell them when you will get your AOR. If you want to buy more time, send it through PAPER APPLICATION. This way, by the time officer looks at your application, you will definitely have AOR in the system. Officer wont have any excuse to reject your application. And incase they do for some weird reason - atleast you will be working under implied status for the next 40 days. I hope that wont happen, specially if you apply through Paper Application (80 days in that case, i guess?)- then i'm sure your AOR will be with you before the officer reviews your application.

Thanks so much InfoSeeker! Scenario 1 definitely sounds worse than 2. Worst case scenario in general would be for me having to go back to the Netherlands for "a bit". I know I'll be back in Canada in a year, but I'd rather stay and not go through the hassle of moving again.

Do you know if I have to do anything after I have applied for the BOWP? Do I need to obtain any kind of proof that I applied for the BOWP and are working then under the implied status? With an online application it'll be easier to have something on hand, otherwise I guess the only thing I can keep is a receipt from the courier?

Honestly, I dont think you'd need to get out of the country.

If you apply through Paper Application, it takes 80 days. You will definitely get an AOR before the officer even reviews your application. To make this work 100%, send in the paper application just 14 days before your WP expires. But send it through Xpress post or Next Day Delivery. So incase, some screw up happens in Postal, you still have time to send another application before your WP expires :) Your 80 day implied status will start from the day CIC receives your application. From current trends, your AOR will be in your hand (and in GCMS) by 1st June - well before the officer opens your file for BOWP.

Regarding proof. I applied online. For me it was the online confirmation. In your case, I believe the courier receipt and your fee payment receipt will be the only proof.

It's definitely worth the try - thanks so much! So great to finally be able to talk with people in the same/similar situation. Much better than just getting the short "oh it'll be fine" comment I get from the people around me :D

Hi Guys ,

I just want to clarify that applying for immigration does not give you implied status . I have confirmed this with my lawyer. You get implied status only if you applied for extension or another work or visitor permit. Anyone who is in this situation should get visitor visa asap or should apply for one and till the decision on visitor visa is pending you ll be under implied status .

We are talking about applying for BOWP and that will give us the implied status - till the final decision on WP.

Lets not be negative here.

Info's calculations are correct and LCM should be doing exactly what Info has advised, she has no other choice.

Not being negative at all but i think we should be informed so we are better prepared when situation arise. I know if you in the situation you ll take the steps being discussed but its always good to know what else to expect.
