BOWP after returning back

Hi,

I applied for PR under CEC on 11-Dec. with current speed I'm expecting to get AOR in Apr-15. my current WP & TRV is valid till Oct-15, however my employer is sending me back to my home country.

Now my question is, will I be able to return back to Canada using current WP/TRV & apply for BOWP between June & Oct? I need guidance for both scenario - in case my company sends me back for other client or if I resign & come back on my own?

First off your employer can not send you back, unless you want to go back! Or you have to take care of business back home, say a contract job!

Secondly you can get out of the country but when you get back (if there is a big gap of absence, without you working for the company) the immigration officers will definitely question you, because you were bound to work for your company and your company was bound to give you the job and employ you. So you might want to watch that.

Thirdly, if you make it back to Canada, under current rules for BOWP, you can definitely apply for one if you have 4 months or less on your work permit by then, considering you have got your AOR by then.

And last but not least, I assume you have a TRV for getting back into Canada not just a work permit. Do your calculations wisely mate! You don't want to mess it up.

Thanks! I was sent by company on intra-company transfer. So, company wants me to support same project from my home country now. As I can't apply for BOWP now, I have no other option except going back.

Yes, I do have TRV. However, not sure if as per rules I need to disclose my work permit status mandatorily. I would prefer to wait till I get PR, rather than breaking any rules.
