They will know you overstayed as you will have entry stamp for Canada and then another when you enter the US, so they will put two and two together if there's no other stamps in between. It will be up to the individual discretion of the border officer you get, they may have concerns about whether or not you will leave on time if they let you back in. I am in no way saying you won't get in, just be aware it could raise some flags.

Maybe you want to file for restoration of status, before you leave Canada?

Unless you're a US citizen, there is even a chance that the US border guards wont let to into the US. I once travelled to america near the end of my 6 month visitor visa (still valid) and they almost didnt let me into america. I guess because they thought i might be a risk and might stay. However they did eventually let me enter US for a vacation and then my return to canada was absolutely fine. Although I was leaving canada to head back to the UK a few days later.

My hubby tried to cross into the states for the day, he had his permanent residence visa in his passport, but we decided we wanted to shop first. He had overstayed his 6 months, but I had brought the paperwork to prove I had applied for an extension. They denied him entry to the states since he had a expired visa from Canada. Thankfully for us, we knew he'd get back into canada. So be careful because they can be verrrryyy strict about trying to travel into the states if your visa is expired

I am from the states and I get hassled even at times. I would restore status because you do not want to get flagged in the U.S. system. Once you get flagged you often have to apply for a form 192 which for Canadians means at least a year of waiting and almost 2,000 in fees before it is all said and done.

thank you everyone!
i cant apply for restoration, because i had a working holiday visa, and i cant extend that kind of visa! i tried! :(
but for example, if i wanna go to Mexico instead of USA for vacation!? i dont need visa for Mexico, because I am allowed as tourist for 6 months! So Mexico border guards just gonna let me in? And when i am gonna come back, can i say canada border guards, that i left Canada long time ago, that i flew back to europe long time ago(because in Europe i dont get any stamps in my passport), i have applied for PR ( i can show him proofs), and i flew to Mexico from Europe, and now i am coming back to Canada as tourist, to live together with my husband! does it gonna work? or better stay in canada and dont go anywhere?

thank you everyone! :)

you dont want to lie to the border guards. Generally they can see right through you. If I were you I would count myself lucky that I am with my spouse and stay here instead of risking it all for a vacation.

A friend of mine went to the US border a few times. When he said that he only came to get his new work permit for Canada, the officer said that he was familiar with this ('flagpoling'). He didn't allow him to enter the US, but he didn't make a record of it either. So no trouble in the US and he could go back to the Canadian border office for his work permit.

Your status in Canada should not be of any effect for getting into the US, as far as I know. If your passport is okay, you got finances to support yourself during your stay, it should be alright (for visa exempt citizens that is).

Obviously its better to stay in canada due to all the risks that leaving poses. But yeah, Mexico would probably let you in and you could say that you flew from europe. That would work but lying to border guards is not the best and could cause problems for you.
Its all just risky and ultimately up to you if you want to take the risk.
