I got an email from CIC requiring my baby's Birth Certificate and Custody Documents.

We already handed in her birth certificate when we were applying FCS.

My husband is sponsoring me and our daughter through family class sponsorship inland. We all live in Canada now. We handed in our application materials last July.

We are our daughter's biological parents. She was born after we got married. She is 3 yr. It's the first marriage for both of us. (Of course we are still married. :-X)

So my questions is, do we need a Custody Document? Where will this Document come from?

i certainly would not advise neglecting the email. that is a sure fire way to get your application cancelled. i recommend sending another copy of the birth certificate along with a statement that says you and your husband are the biological parents and your daughter currently lives with you, so there is no need for a custody agreement. I would imagine custody documents are only needed when the applicant doesn't have full custody of the child. Also, re read the letter very carefully. look for words such as "if". Most letters sent are generic and are not specific to a persons application.

Oh yes, there is a "if". In the email:
"If you have not yet submitted the following documents, you must submit them to this office:
Birth Certificate and Custody Documents"

I can do what you suggested, send the birth certificate again with an explanation letter signed by both of us. Will do ~Thank you

thank god I found this page and I found the exact problem I'm in right now.
The thing is, me, I'm the biological mother and the only parent in the birth certificate of my child (My husband, our common child and me are all in Canada right now. As my husband and I had a problem to legalize our marriage certificate, which come from St Lucia, in Vietnam so the baby, born in Vietnam, cannot have her father in the birth certificate).
My question is: If I'm the only legal parent in the birth certificate of my child, do I need to provide a Document of legal custody?

Since your situation is not very common, maybe you want to call the CIC call centre to see what the agent would suggest.

Calling CIC
The fastest way to speak to someone: 1-888-242-2100,
then Dial 2, WAIT, Dial 1, WAIT, Dial 1, WAIT, Dial 0 - then wait for operator (was working on May 04, 2015)

There are a couple competent agents who can really help you with reliable information. But unfortunately most of the agents know very little about the process and sometimes they can give you wrong advice or make up things just to tell you something. Calling CIC is not the best way to obtain information. If you really need to find out something maybe it’s the best to give them a call 3-4 times, and if you are getting mostly the same answer than you are all right.
