BF's d according to caips-note pre Feb 2008 applicant

Dear Forum seniors,

Please share your experience in the following issue:

I am one of the pre- Feb-2008 applicants in skilled worker class. My caips note is as follow:


PSDEC: 1 04-06-2011
SELDEC: 0
Total points: 55
Paper file sent to BP file BF’s d to: PB on 15-12-2012 MICROLOCATOR

However my points for IELTS test have not been calculated because ILETS test result was submitted to them by Brithish council in Islamabad only 4 days after the deadline in May 26 2011. The deadline for submitting all my original documents was May 22, 2011. So when I submitted my documents I only attached the slip of my ILETS test along with a cover letter that they will receive IELTS test result within a few in-coming days. Than they acknowledged the recite of my ILTEST test result by e-mail for which I can get 12 points.
Based on my caips note, I was expected to hear from CHC, Islamabad. But today is 22 of Dec 2012; still there is no news for embassy. I am getting worried. Could anyone from this forum PMM, Qorax,….. shed some lights on this that normally how long will it takes to hear after BF’d according to Caips note. On the other hand, my IELTS test result will be valid till May 8, 2013.

Dear I don't want to disappoint you but I think your application will be terminated and fees refunded according to law passed on June 29, 2012. According to this law if you don't have SELDEC=1 before March 29, 2012 your file will be terminated and fees refunded.

In some cases though correct SELDEC was not entered in CAIPS notes for pre 2008 applicants but visa officers were instructed to do a manual review of all cases and finalise that manual review by Nov 30, 2012. Ans you can see that now today is 22 Dec 2012 and Nov 30, 2012 has passed and you don't have SELDEC=1 in your notes.

Can you please tell when you ordered CAIPS notes and what is the date on your CAIPS notes that they extracted for you?

I hope and pray above will not come true for you and you will get your visa soon.

Return of Fees for Certain Federal Skilled Worker Applications: Actions Required of Visa Offices

Summary

The Jobs, Growth and Long-term Prosperity Act became law on June 29, 2012. Under this legislation, Federal Skilled Worker (FSW) applications that were made before February 27, 2008 were terminated by operation of law if a decision based on FSW program selection criteria had not been made by an immigration officer before March 29, 2012.


Applications requiring manual review

A subset of all the FSW applications affected by the Jobs, Growth and Long-term Prosperity Act have been identified as requiring a manual review by visa offices to confirm they were in fact terminated by operation of law on June 29, 2012.

These FSW applications represent those for which a selection decision may have been established in case notes before March 29, 2012, but for which the decision code was not entered in CAIPS/GCMS.

This manual review will ensure that NHQ – Finance does not return fees in error for those applications where it is determined a selection decision was in fact made, but where CAIPS/GCMS data did not accurately reflect the decision code.

NHQ – Finance will provide visa offices with a spreadsheet listing FSW applications requiring a manual review of case notes. Visa offices should take the following steps in reviewing these applications, tracking the results, and returning the spreadsheet to NHQ – Finance:

The visa office will conduct a detailed review of the case notes in CAIPS/GCMS for each application listed in the spreadsheet provided by NHQ – Finance, and determine if a selection decision was in fact made before March 29, 2012 in accordance with the guidance provided in OB 442.
If it is determined that the application was in fact terminated by operation of law, the visa office will record the results of their manual case review as indicated in the spreadsheet provided by NHQ – Finance.
If it is determined that a selection decision had been made before March 29, 2012, and the application was not terminated by operation of law, that decision code should be entered by the visa office in CAIPS/GCMS and the results of the review should be noted in the case notes. The visa office will record the results of their manual case review as indicated in the spreadsheet provided by NHQ – Finance.
The visa office will forward the completed spreadsheet to NHQ – Finance by no later than November 30, 2012 at: FSWFeeReturn @ cic.gc.ca.
Note: No further action is to be taken by visa offices with respect to terminated applications at this time.

First do not be worried that you are not in the eliminate group because your file was assessed before 29 March 2012 and you were awarded points.
Your score is 55, IELTS points were not added. You were late to submit IELTS result but sent slip. I know some one submitted IELTS result more that 2 months later and found in the CAIPS note 10 points were awarded.
What to do now? I strongly recommend you to send by fax and email copy of your IELTS result with an explanation letter that you are submitting again the copy of your IELTS result which you are not sure if reached before. Do not mention that it was late or you checked the CAIPS note(not wrong to mention but as you were late so they are right not no give you points).

If we assume that file was assessed before March 29, 2012 and correct SELDEC was not entered at that time then according to their law by dead line of NOV 30, 2012, correct SELDEC=1 should have been entered by now. But it is still SELDEC=0.

Do you still think SELDEC can be changed from 0 to 1.

I am afraid your application will be terminated no matter what you do. Sorry for the disappointing news but it is better that You know the truth now than later. You could join the lawsuit which challenges the elimnation of pre 2008 files or better you could reapply in May 2013

just to add that I applied for Caips note in Sep 2012 and got it on Oct 9, 2012. based on which I was waiting to hear from embassy after 15-12-2012 which was my BF' d.

As I mentioned, my IELTS result has been directly forwarded to CHC Islamabad quoting my file no. and CHC Islamabad also confirmed the recite of my IELTS test result. this is also mentioned in caipts note. I do not have any copy of my test result, just check it through their website on that time. so shall I take another IELTS test.

Furthermore, I was not awarded points for relationship with my sister in Canada. as the birth certificate was not accepted so I wrote a letter to CHC Islamabad on Nov 28,2012 and added more documents as proof of relationship with my sister, and also cleared that I have not been awarded points for IELTS test and send them by post.

In addition, I send 3 e-mails to CHC Islamabad about the changes in my address and new baby born in my family before this letter, but there is no feedback I really got worried even got sick.

In my opinion you have ordered your notes a bit earlier, you should have waited till NOV 30, 2012. Regarding Ielts you don't have to send another Ielts if it is mentioned in your CAIPS notes that IELTS was received by CHC Islamabad. Just wait and see if they award you points for that. Regarding BFD it can take some time to hear after BFD, your BFD is just passed 15-12-12. I am just surprised that your paper screening was passed on 4-6-11 and points awarded were 55, if they had received IELTS on 26-5-11 then why didn't they give you points for Ielts.? May be it was late..

My opinion is just wait and see and best of luck to you..

Note. If you still want to send another Ielts go to British council and ask them to send another IELTS to CHC Islamabad. They will charge you some fees like 500 rupees or so. You don't need to take new Ielts test. Thanks

Few months ago 3 of my known person got CAIPS note. Two were not awarded points for relatives. Reasons were found in both cases no proofs of living in Canada were not submitted, for another one different spelling for father`s name. For my case I was not awarded points for my nephew though I submitted birth certificates of mine, my nephew and his mother(my sister). Later I sent an explanation letter how are we relative then 5 points were awarded.
One applicant sent IELTS result but were not considered(no reason showing) so she sent again the copy and later found were awarded 10 points. I said before about one person submitted after giving time.

How come you did not make copy of your IELTS result? Better collect a copy of old IELTS result and send again with the receipt copy.
However, better for you to get another CAIPS note to see what entered withing 30 November 2012. If you feel you can take another IELTS and score will be better than before so you can take also.

I think yes it looks your application is not terminated as you were asked to send updated docs and your application was assessed before March 29, 2012 (Correct SELDEC=1 is supposed to enter after Nov 30, 2012). Only worrying thing is the points, they gave you 55 only. I guess they will give you points for IELTS later on if they had already received it as per your CAIPS. Time will tell.

Why don't you order another CAIPS as your BFD is already passed. Good luck to you dear..

Congrats!! As your PS done before 29 March 2012 but you are still in risk because of 55 points. I recommend you to send a CSI that you submitted IELTS result and simply mention that you are inquiring if that received. Also get another copy and you may send that also as attachment. I repeat do not worry about SELDEC.

I have quoted her file no as well. so they can check her documents as well. the only problem is that in our culture when a girl gets married, her family name changes to her husband's. I have mentioned this in the letter. furthermore, CHC has confirmed the recite of my ILETS test result which is also mentioned in my Caips note. so what you think shall I send them another copy of IELTS. and can you calculate the points for my above mentioned IELTS result.

One thing is clear that your application is not terminated so no worries. I guess you should order your CAIPS notes immediately to see if they have given you points for Ielts after BFD. Your CAIPS tell that they did receive your Ielts and you also got confirmation by email that they received your Ielts so there is no points sending Ielts again.

I suggest you should also write an urgent email. In subject of email write urgent and enquire about your status. I hope you will get an answer. The email address of Islamabad office is
