Here is our story. I'm in love with a Filipino live-in caregiver. I'm a Canadian citizen and she is a temporary oversea worker for 8 months now. What is the best way possible to get her permanent residence status in Canada, and an open work permit so she can work for any employer. Right now, she lives and works in BC and I'm in Alberta. My options are:

1. Get married to her, and sponsor for permanent residence status.
2. Allow her to work for upto 2-yrs and then apply for permanent residence status on her own.
3. Have her terminate her contract in BC, get a job in AB and then apply under provincial nominee program after 1-yr.

I need advise on the best possible scenerio.

My background.
I've had an unsuccessful sponsorship application in the past with my ex., so I am trying to avoid sponsorship. Although my ex was outland sponsorship, will it affect an inland sponsorship?

Why was your prior sponsorship refused? If it was because you were not approved as a sponsor, you have see if you can fix that before applying again. If it was because they did not believe that the relationship was real, then it should not affect a 2nd sponsorhip.

If you let her complete her two years and then apply for PR, she has to continue to work as a live in caregiver to stay under the live in caregiver program and it takes a year right now to get first stage approval and open work permit so you would be looking at about 2.5 years apart.

You can definitely try to find her a job in Alberta. You can see if the employer can sponsor her for PR directly through the PNP or if she can get a work permit to come work in AB. It depends on what her skills are.

They did not believe the relationship was genuine and were going to deny the application, but I withdrew it before denial. I hope this won't affect another sponsorship. So you think its best I sponsor her for PR?

I think it might affect a second sponsorship. The visa officer might think the person enters into relationships too easily, or has poor judgment. I would expect the visa officer to scrutinize the application even more carefully than usual because of the previous suspected marriage of convenience. Still, if the proof of a genuine relationship is solid this time, they should still be able to get approved.

If you want to avoid sponsorship, choose option 2 or 3.

Hi Rjessome,

Do you think it's worth it to marry my girlfriend and apply for inland spousal sponsorship, or wait another 14 months when she will be eligible to apply for PR on her own? Do you know how long the live-in caregiver PR application takes?

I don't like to answer questions like this. Deciding to get married is separate from immigration. Technically, if you marry for the sole purpose of gaining immigration status (PR) under the Act, you are complicit in a marriage of convenience. I know, a lot more goes into it than that. Personally, my own opinion is that if someone has another option, other than spousal sponsorship, available to them to become a PR, I would take that, hands down. That is my personal view.

Thanks a lot Rjessome for yout two-cent. Well, we are in love and its no marriage of convenience, however, we must decide when is right for marriage rather than rushing into it and having it without our families presence. I will take to your advise to try to avoid spousal sponsorship if I can.
