I am reading through some of these threads and seeing people having to appeal their cases even after sending in so much evidence (pictures, convos etc) what reason would they have to reject 2 people wanting to just be together and live as a family like everyone else gets a chance to? How can you refuse someone who has shown so much evidence? Looking at all this really makes me sad and worried and depressed. :(

Its life. Its unfortunate but we have to deal with it if we want or not. I would fight them tooth and nail and if my country does not allow my family to be together than I am rejected and will leave to have a family. Thats all to it.

The quality of the evidence is not solely a function of its quantity. Sometimes, the story being told is not supported by the evidence, even though there may be a lot of it. Never forget that the motives of the foreign national are always under scrutiny, in some cases more than others because of where they are from, actions they have taken in the past, or even actions in the present and what they are putting forward for the future.

It's more than just the amount of evidence you send in, there is also an evaluation of whether the evidence supports the case to be made.

When you read the hearings of appeals, you see that many rejections are made based on some "rigid" criteria without considering the evidences supporting the genuineness. A good example of this is the incompatibility mainly in terms of age, education, culture and religion, and social status. If the age difference is very significant, they usually reject the case even with good proofs (like 50 year old man married a 20 year old girl) even if the relationship is APPARENTLY genuine based on the proofs submitted. Another example is a PhD man who married a girl without high school education...or a muslim man who married a hindu woman..and so on. While it is true that these disparities raise a big suspicion, the case cannot be rejected if there are solid proofs that overcome this disparity but they easily do and let you deal with it at the ADR or federal court.

I also felt very depressed when I went over many stories but I just hope for the best. I think it all depends on the officer who reviews your file and how he/she wieghs things.

Are you saying that even with a lot of supporting evidence (pictures, hotel invoices, airline tickets, passport stamps, letters from family and friends, rental contracts, joint account, etc...), there is still a chance they could reject the application based on things such as age, religion, etc? We have a son together, shouldn't that be evidence enough? Yes, I am 9 years older, but how can background play a role? I'm from Canada...my wife is from China...of course there will be differences...I don't see how they could use that against the applicant...

How can't the evidence support the case? If we have a son and a lot of supporting evidence, I would be really angry if our application was rejected. They'd have to have a bloody good reason...which I don't think they could possibly have based on our application...

Oh God,your situation really made me worried by now... :(... bcoz when it comes to evidences,what we have are only a few such as 5 pictures with friends in a different gatherings,the pictures for just the two of us are a lot and also with our 5 month old.we dont have the joint bank accounts,he only transfers money every payday since i also have to send my daughter in the phils.we dont have trips or outings yet but are planning to be in his hometown on july.we did go out for dinner but we dont mind having pictures ...what we have are the messages and posts in facebook with comments from our family and friends.our conversation in msn and skype from the day we meet.
hE is already asking letters from employer that i have been his emergency contact since march last year,i and our baby are his benificiarries in his insurance ,our lease agrrement ,and letters addressed to each of us.

Do you guys think our proof aren't sufficient yet? we are planning to get married when we go to his hometown in newfoundland but we are sending our application med of april...I am soo worried...any input from you guys?

FS, dont be offended BUT you are paranoid. Honestly I am sure that your application will be approved! It is all a game of chance but stressing over and over on every little thing is going to make you crazy!! Charlie was just pointing out that sometimes loads of evidence still doesnt prove anything if the evidence doesnt paint a genuine story. For example you could have 100 pictures, but if they all seem stiff or posed or unbelievable then of course they (immigration) will see thru this. As long as you are a genuine couple believe me, it will go thru. I bet you will be surprised at the ease you have throught this process. At least you are with your spouse and have the chance to raise your child. others dont get that chance so look on the bright side!

Not offended at all...I AM PARANOID! Not just that, but I am seriously on the edge when it comes to China. I can't stand it here...I hate it, in fact. I used to like it, but that was during the 'honeymoon' phase...I have to get out...and I cannot (will not) leave my wife here...so this is SO important...my wife's application is as if it is for me, too...because if she doesn't get the visa, I'm stuck here...which I don't even want to think about...

Okay, I will try to relax a bit...it's tough...but I will do my best...a few cold beers after work tonight should help...

LOL I am glad your not offended! Trust me, I have my own paranoid demons and hurdles and our app went thru so smooth I almost didnt believe it...She will get the visa, just dont make yourself insane on things you cannot control! Focus on your wife and baby, it will soon be over. Have faith in your love.

our story is pretty the same as yours but today we got two letters that says we met the requirement to apply PR under spousal sponsorship. 2 days ago I got my open work permit.

Okay, I don't have passport stamps or airline tickets or phone bills to show...but we've been together for 15 years and married for 12 years so they will think it's reasonable not to send or have those right? I'm now thinking if i should dig up our old online chat and emails to each other back 13 to 15 years ago, do you think i need to send some of those??? I'm a little paranoid one too myself. We have 3 kids together ranging from 3 months old to 6 years old. I have about 56 photos I'm sending them from the time we started dating to present time. One of the pics is of my husband in the operating room with me right after I got a csection with our 3rd son...still laying on the table holding my newborn with my husband right beside me smiling at the camera, lol. So basically what you guys are saying that they will only deny spousal applications if they are suspicious that the couple is really together right? My uncle in Toronto was about 50 years old when he sponsored his wife from China over and she was about 33 years old at the time. And she got her residency and was able to go to Canada...and now they have 2 boys together. So Fencesitter, don't worry about your 9 years difference. My uncle is a cook and speaks very little english, but he owns a house in Toronto w/ 2 older boys from his previous wife who passed away from cancer. But anyway, you throwing in a case that got approved.

LD- you are a next one I am calling the paranoid police ON!! Trust me after 15 years and 3 kids, and you are just sponsoring him now why would they doubt the validity of the marriage??? You guys are wayyyyy overthinking this. Sometimes too much overthinking and too much evidence can also make you appear desperate so just be COOL. you have great proof.
