been Charged with Domestic Assault

Hi everyone

I applied for Canadian PR under Provincial Nominee program in june 5015.....I got my Medical Request now.....

In January 2016, I have been charged of domestic assault...it is in court...I have been charged but I am still not proven Guilty by the court

Now wht will happen to the application will application be cancellled now itself or will cic put on hold untill I am proven guilty or will they process the application ....

I had written a letter to cic explaing about the domestic assault and it still in court...

my neighbours called police saying that they heard hitting sounds from my room... whn police came since my wife cant speak english...she was afraid of police and did not know how to speak she told them that i holded her hand but the police misunderstood and thought that I twisted her hand and police charged with domestic assault....now the case is in court.....

Now I am worried what will happen to my application...thanks

Why don't you take your wife to the police and get her to sign a statement saying that you never hit her? If she just explains everything to the police, should be easy to have the charges thrown out.

Did you already send the letter you have written? If you haven't I would hold on to it for now and let the cards fall where they may.

For the rest of the forum who reads your post, there's still an elephant in the room, . . . what were the "hitting" sounds your neighbours are referring to?

Yes, what were those hitting sounds? The neighbors wouldn't have gone so far as to call police unless they were extremely concerned there was something going on. Also when the police arrived, if your wife doesnt speak English and she seems extremely distressed, and had bruises, they would likely assume she was assaulted. I don't understand if no assault occured, why wouldn't she have tried to explain this to police, with you translating? The police wouldn't have gone so far as to charge you unless they have spent a great deal of time trying to piece together what happened. And why were you holding her hand in the first place? Were you guys having a loud argument? Something seems to be amiss here.

I know truesmile, but at the same time, if this was just a simple misunderstanding due to a miscommunication/lack of English, the OP should've easily had the charges dismissed by taking the wife to the police station, or even on the night the "assault' occurred. It's been an entire 2 months now since he's been charged.

Once charges are laid...the police nor wife can withdraw or dismiss the charge...its only the crown attorney who can dismiss the charge....the police took wife to bedroom and did not allow to come near by....I holder her hands to give her the mail box keys to check the mail....

You can expect CIC will put your application on hold until the outcomes of your court case is known. Make sure you are working with an excellent lawyer.

I am sure we don't know the true story here, we know neighbor is not stupid, wife is not stupid, police is not stupid, and OP is not stupid so that situation what fell into this state is simply impossible based on current version of story.

But not telling IRCC about the charge could be considered fraud.
