I am currently in the process of trying to find a way to get my husband to Canada. I was not discharged from a previous bankruptcy, and I know that is an issue with sponsoring. My question is is it also an issue with a spousal visa? I know that I have been told finances arent involved in the spousal applications as much as others, will the bankruptcy affect the visa? Will it be denied? Any help in this area would be fantastic!
 
I've never heard of specific cases, but I believe until you're relased from bankrupcy, you are unable to sponsor anyone.

That is one of the forms required. See the 'Eligibility Assessment' part on page 4.
 
If I say on the application that I am not an undishcarged bankrupt will it show somewhere that I am one? My bankruptcy is almost done but I need to apply for this before I am technically discharged. If I say no, how will they know that I am? I was under the impression that if I claim N/A to the option C printout it would be okay, as we are married so the financial situation isnt relevant. Please advise!
 
If it's almost done, then just wait until it's done. LYING on the forms is misrepresentation and it can lead you to a whole different mess where you'll never be able to sponsor. You do not want that.
 
You have to submit Option C printout, if you do not, they will request it and your application won't be forwarded to overseas visa office for processing.
 
I was living in the UK, so I didnt claim taxes last year in Canada. What will I do for an option c printout? will they still give me one if I havent claimed taxes?

If you were abroad you can simply let them know that. You have to write down reason why are you not sending Option C printout.

Get a letter from CRA (Canada Revenue Agency) stating that you didn't file taxes last year. Provide them with an income statement from the UK if you worked there and a letter stating that you were not residing in Canada in the last year.

About the bankruptcy, you have NO choice but to wait. You are NOT eligible to be a sponsor. If you lie and they find out (don't think they can't - CRA will know you declared bankruptcy) you can be charged criminally under the Immigration Act, and fined and/or sentenced to jail time. Your application will be refused and good luck ever trying to sponsor your husband in the future. You will then have a criminal record. Is it worth it? If the bankruptcy is almost done, just wait. We all know it's painful but it's better than the above.
