Could you be a bit more specific?.

dont jump your guns.. read it carefully.. it's all cool... not rejected because of 0213... rejected because of wrong claim in form...

i think 0213 ppl need to be a little careful because the 3 rejections i've heard till date have been 0213.. but that could be because max applications go from 0213...

so, chill and cheers!!!

Yesterday I got call call from David Cohen's law firm and they said we will file your case instead of appeal on your refusal of AINP. I aksed them why you couldn't appeal against my refusal? in reply they said now CIC are no more interested for the IT (0213) applications most of cases are being rejected and some are in pending status, they already got a lots of application for IT category.

if CIC has fixed some quota for IT persons then it must be announced officially so that more IT guys will not apply anymore.
I have heard/read from other forums that new NOC will be display soon....May be 0213 will not be included in new NOC and CIC is filling this gap by denying people

How many of you listen to the Financial News? Some top economists of US predict that the recession would be much less in the 3rd quarter of 2009 and the condition will improve in 2010. [CNN]

Canada needs more n more people in that 38 professional categories.
Thats gotta be a rumor. Anyone posts such information must include proper source.

There are many others reasons for refusal in IT category, people make funny and serious mistakes for which they get refused and then blame their profession for that. Weird.

In terms of the posting you commented on, regarding Occupation NOC#0213, I just wanted to ressure you that our law firm has not received any information indicating that occupation will be removed from occupation-lists at any point in the near future.

Of course changes to Canadian Immigration rules and regulations can be made at a moment's notice, and one must always be prepared for that.

However, at the moment we've seen no credible or clear indications that this particular occupation is due to be removed.

While the forum format is a highly valuable resource, sometimes there are rumors and miscommunications that can spread in this type of format, so I just wanted to clarify what may turn into a false rumour.

Please note that NOC code 0213 (Computer and Information Systems Manager) is currently one of the 38 "qualifying occupations" under the Federal Skilled Worker program and is currently listed on the Alberta AINP Occupations Under Pressure List for the Strategic Recruitment Stream - U.S. Visa Holder Category. Neither I, David Cohen, nor any member of my law firm has advised anyone to the contrary.

I am really surprised while people discussing and passing this type of comments regarding the rejection of applications which are holding certain NOC. I dont even trust this 0%. Because this new law is all about Changes and Minister have no problem to issue new instruction. I have't seen any councling or Round table meeting of minister with stakeholders regarding any new councling or something like that at media link.and this is the best source to forecast changes rather then guess it with gossip. Secondly with this new law, all of the data (By Profession) is being maintained at a single office and they exactly know that how many application are being recieved for certain profession and what are their targets in this regard. And if something is overloaded then rather then making people fool , the minister have the power to issue new instruction in a very short period.

Admins should warn those for a possible ban who are spreading the false info about having a quota of code 0213 by CIC under any provincial or FSW system. Some people are worried about their chances and they are spreading those rumors those have no bases.

Well, folks... it finally came, the rejection letter. I had applied under 0213. The foreboding delay itself made me suspect that things are not good. Here are my details, which hopefully would benefit the future applicants. Suggestions are welcome.

Time line:
Applied to Sydney, NS: January 23, 2009
Received AOR from Sydney: February 19, 2009
Sent full documents to New Delhi CHC: March 30, 2009
'Not eligible for processing' Letter: Dated April 20, posted June 4, received June 8, 2009.
e-CAS status since May 13: Visa office eligibility review complete.

The gist of the letter is this:
You have indicated that you have work exp in an occupation with the following NOC code 0213. Although the NOC code corresponds to an occupation specified in the instructions, you do not have a minimum of one year of continuous full-time or equivalent part-time paid work experience in this occupation in the last ten years. Since you did not provide evidence that you have work experience in the listed occupation, you do not meet the requirements of the ministerial instructions and your application is not eligible for processing.

My profile is: Job title: Director, Data Processing. The Indo-Swiss joint venture is owned by me and my husband and was incorporated in 2006, since which time I've been working there. Since 1999, I've been working in the managerial cadre in the ITES industry (maybe they are looking for pure IT managers only).

Evidence provided for the latest job:
Company formation letter which lists me as the Director. Did not provide an appointment letter since I was also the owner.
Reference from the Managing Director (who is also my husband. I had pointed out this fact myself and also included the business card of our CEO, who's in Switzerland). I had taken care to put the job details/responsibilities closely matching those given at the NOC.
1 year's bank statement which showed the salary credited every month.

Somehow, I was under the impression that Sydney, NS was the tough nut to crack when it comes to the NOC list and ND would be a walk in the park. Apparently not! I had been running around for the PCC, proof of funds and IELTS (overall band 8), all to no avail. I'm genuinely surprised that they didn't even ask for further evidence, which proves what the Seniors have been saying here: there will only be one shot at this; they will not come back to you asking for more evidence.

Anyway, I'm going to give it another try by asking the CEO to fax the CHC directly explaining my job responsibilities. However, I don't think it'd make much of a difference since they have already rejected my case and not asked for further evidence. The only solace is, since they've determined that I'm 'not eligible' they have promised to refund the processing fee within 4 to 6 weeks.

I know it's too early, but is there anybody who has appealed their case after a rejection at the second stage? If yes, please let me know how you went about it.

May be it is a rumor but one of the poster's mentioned above did get her application rejected and from her postings earlier it had appeared that she was quite positive she would get her PR visa. May it was just a co-incidence that the applicant was from 0213.
