Bad Joke from CIC

Dear exerts,
I'm currently on the work permit that will end at July 1st 2014 (3 years).
Last year I applied for CEC. I was sending the application according to change that took place from Jan 2nd 2013 (24m ->12m).
I sent my application at December 31th 2012 with registered mail by Canada Post to CPP-O Ottawa. Case went through eligibility control and was queued. Yesterday (after 11 months) I got an answer that I'm not eligible since I wasn't working in Canada during 24 months. And that application receiving date is Dec 31th (from the registered email stamp). So 2 days are missing before new rules took place. :'(

Is there something I could do besides submitting appeal? Any QA control managers email addresses?

Just to clarify, did you send it on the 31st or did CIC receive it on the 31st of Dec? If its the latter then you are out of luck and there is nothing you can do about it because technically, CIC are right to refuse you. The new rules didn't take effect until Jan 2nd, so anything before that would be assessed under the old rules. Sorry to say, but any appeals would fall on deaf ears. Good thing is that you can reapply, as long as you are sure that you qualify. If you sent it Dec 31st, then CIC miscalculated and you may have a case.

Well you asked what you should do: reapply
Once you get your aor, you can apply for a bridging work permit and get another year's work permit

Reapply for PR soon enough. Once you get the aor, you can then apply for a bridging work permit. If approved, that permit would be 1 year in length and would be an open work permit. You wouldn't need your employer to do anything for you. Keep in mind you can only apply for a bridging work permit with at least 4 months to the expiry of your current permit.

is it a bad joke from CIC or stupid mistake from you?
I am quite amused that people make mistakes and then blame CIC for the same.
I would suggest you acknowledge your mistake and re-apply again. As soon as you get AOR apply for BOWP as suggested by other members.

I'm for sure acknowledging my mistake. My only concern why such easy eligibility question took 1 year to answer? Shouldn't that check be done before AOR is issued?

Spot on! People fail to realize that just becuase CIO is a regional processing center under CIC, doesnt mean it communicates with CPP-O. They have their own mandate, which is to ensure that you have submitted all the required docs, paid the fees and signed the forms.

The eligibility checks are done at CPP-O. So in fact, they were right to forward on your application, and shortly after, refuse it. Its a harsh reality, but it is what it is. This is not about assigning blame...instead, aknowledging a mistake on your part.

Now, to be more productive - reapply with updated docs, get your AOR and submit for BOWP. If there's anything good that came of this is that you can get GCMS notes and see what the VO said about your eligibility and NOC compatability. You will know from the get go what to expect. Once you're done with all of that, join us in the queue. Good luck!

Agreed. There was no mistake made by the CIO. The only mistake here was made by the person who applied too early.

They actually do first stage approval. People do get refused from the CIO. Their scrutiny is just not as thorough, and they will forward applications that are not so clear cut.

I disagree with this. When was the last time you heard CIO pass eligibility? What you mean is they "approve in principle". We only saw a few pilot cases where eligibility was assessed, but no one can decipher the reasons why. CIO looks over the completness of your documentation and the most basic of checks. You could argue they would send back in case you didnt fulfill language requirements (one of the eligibility criteria), but their checks would be if you included legitimate proof and whether you are in the range - not an actual determination. Things suchs as birth certificate format compatibility, signatures, required included documents (checklist checks), payment and so forth. CIO doesnt make a decision on your eligibility. The most I have seen is that they make a recommendation, but CPP-O makes the decision.

Once your application has moved to the next stage from AOR or approved in principle to the elegibility assessment or pass/fail determination, it goes to CPP-O. Even those applications which received a pass recommend from CIO still went to CPP-O and received their confirmations from them. You can see this by reading some of the early 2013 threads. This was prior to the PAFSO strike.

What the procedure will look like going forward remains to be seen.
