AVR - Canada Soft Landing - H4 extension till 2022 (another i-539 pending)

My spouse has an expired visa stamping, but a valid i797 - i94 expires in October 2023.

I too have an expired visa stamping, but have a a valid i-539 (H4) till September 2022.

I have a another pending H4 extension, which was applied for last year but I don't see that getting approved anytime soon. That will extend the i-94 to October 2023 (same as my spouses H1b).

Can we go to Canada for soft landing and use AVR?

What is valid i539?

Do you have an approved i797A/valid i94? If yes. then you are good to do use AVR.

When my spouse changed employers in 2020, we applied again for the h1b transfer and h4 transfer. The h1b got approved within a week but the h4 extension is still pending.

I think you should be good as you already have valid i94, but better talk to your attorney once or lets wait for experts opinion here.

Good to use existing I94(which is valid till Sep2022) and pending H4 might get into trouble(for which you can reapply if denied as you have plenty of time - only issue is that waste of money spend on H4 extension).

Thanks everyone for providing your inputs. Just curious.

1. Are they allowing soft landing now? Isn't travel allowed only for essential purpose?
2. How would you receive your PR cards if you will be travelling back to US from POE?
3. If the officer give you some Travel Reference Number (as stated by someone in this forum), how long is that valid? Is it valid if you travel back at a later time after your COPR expire?
4. Would the PR become active from that day or it will be active only when you land next time (to a complete move)?

We are working in US right now. If soft landing is allowed, I would like to do that since my COPR expiry is nearing.

1.Yes, they are allowing soft landing for most of the people. But also just be prepared if in case they do not allow you to softland but to do 14-day quarantine(but as the country is getting ready to open up, i am sure you would be allowed to softland. do not panic. take the step).
2. As far as i read you can give your family/friend's adress in Canada or some officers allow you to give US address.
3. Not sure but do not risk trying to extend your Copr which will add a big delay due to processing times.
