Automatic Visa Revalidation (AVR) to enter USA

Dear all,

We are in USA thru h1b n have i140 approved. applied 7th year ext and transfer with i140 and waiting for petition decision. currnt Visa n i94 is expired.

we r mid way for canada PR and if everything goes fine, we want to know how to handle things.

Assuming optimistically, we get Canada PR and also h1b extension cum transfer is approved, we receive the approved petition tat will have valid i94.

So if I want to do soft landing in canada to activate my PR and travel with expired stamped h1b but have valid approved petition and i94, is AVR applicable to my situation?

I am not planning to stay in canada for more than 30 days as we r planning to do only soft landing.

Is AVR done only for roadway entry to US-canada? or flight PoEs also does AVR?

Kindly provide inputs and guide us for the above situation.

You will be eligible for AVR once you have approved H1B petition with valid I-94. AVR can be used at both land and air ports of entry. (Sea as well).

Hello members,

I have an expired F1 visa stamped on my passport but currently on a valid H1-B visa with I-797 and valid I-94. But I do not have a H1-B stamp on my passport. Can I still use AVR to return to the US? Kindly advise.

1. Referring to Automatic re-validation rules and requirements:
"Non-immigrants with a valid (unexpired) admission stamp or paper from I-94, Arrival/Departure Record, endorsed by Department of Homeland Security (DHS)."
What does 'Endorsed by DHS' mean here?

2. I have an expired F1 stamp on an expired passport, I have renewed my passport and have a valid I-797 and valid I-94, but no H1 stamp. I understand I am still eligible for AVR, right?

3. Do I need to file any separate documentation /authorization/ forms to avail AVR, or simply exit US and re-enter, provided I meet all other AVR requirements.

What does 'Endorsed by DHS' mean here?

1. Endorsed by DHS means: The I94 should have been issued by DHS. DHS doesnt directly issue I94 but few of its entities issue I94. Their entities include CBP and USCIS.
This means that one should have valid I94 issued by CBP or extended/amended I94 from USCIS.

Yes, I94 attached in I797 is the one you need for you who recently extended/amended/transferred their H1.
