Hi All,

Is my authorized to stay in Canada based on the expiration of my visa or my work permit?

I have visa( TRV) until Jan end , however my work permit expires by end of march. I want to avoid future immigration issues across world.

@scylla -Thanks for response. Does staying in Canada beyond my visa expiration but within my work permit validity period count as overstaying?

My Employer is extending my ICT and as per latest guidelines, they are not eligible for ICT extension due to location requirements. They only have virtual location and don't have commercial premises. What if i will receive negative outcome of my ICT extension and how much time i will get to leave canada and what will be my options in that scenario?

You will fall out of status as soon as the extension is refused and will need to stop working immediately. If you plan to leave Canada, you should do so within 30 days of receiving the refusal. If you want to remain in Canada temporarily as a visitor, then you will need to apply to restore your status to a visitor record.

If you fall out of status in Canada then you are by default overstaying. If you want to avoid this, then don't apply for the work permit extension since you already know you don't qualify. Apply to change your status to visitor before your work permit expires and the stop working as soon as the work permit expires. Of course this will only allow you to remain in Canada temporarily as visitors. Ultimately you need to figure out what your long term plans are.

If you are applying from your home country, then you would be applying for a new work permit and not an extension.
