Me and my husband are living currently in England, However I am Colombian and I am under a student visa.
I finished my course for 1 year and my visa expires the 23 of September.
My husband and I applied for the permanent residence from here and now we are waiting for the decision. ecas says it is in process since the 29 of Nov that we received the sponsorship approval.
So.... based on the previous applicants I've noticed and particularly in London the process after the approval is taking aprox 25-30 days to the passport request. that means that In January we would get an answer.
I have 2 options.
1- Extend my visa for a few months which will cost me lots. but. I would be inside the country where I applied. ...d k
Or..
2- wait till the answer in January (or if I need an interview by jan I would be called by then) and the 23rd Go to my country with my husband and wait for the passport over there after inform them that I have moved back.
Is that possible.? after all ,If by then they ask for a passport means they would have made a decision already even if I am not inside of England anymore they would still have to let me know the answer.
I am confused. And I don't have much time..

You say your study visa expired 23 September, so are you currently in England as a 'visitor'? Is this why you would stay in England until January 23, or some other reason? I ask because there is of course a chance London could take longer to process your visa, especially over the holiday period where they may not be working at full capacity. There are a lot of cases where further information needs to be sent.
If you are able to stay in England, then I would suggest staying on as long as you can, in case there are delays with your case. I think my other concern would be that even if they were able to issue a Visa as quickly as they have some others, there's no knowing how long they will take to issue the visa. Also, if you weren't still in England they may refuse to send your passport back all the way to Colombia. I think I have seen in copies of passport request letters people have posted in threads elsewhere on this forum that they will only return passports to countries in their region, which makes sense, it is an important document and a big risk to send so far.
You could ask for it to be transferred back to the VO for Colombia, stating the need to return home as a reason, but that might delay things.
Sorry, this may not have helped, but I'm only saying what I would do in the same situation, but I'm pretty cautious. You might find everything goes really smoothly and wonder why I was so worried!

I understand your anxiety though. I am hoping a decision will be made on my case very soon. I live in New Zealand and my partners father (in Canada) has been given 6 months to live. We are desperately trying to move in time to be with him. I could just go now, but if I had to have an interview I'd have to go all the way back to my Visa office in Australia, which is an expense we just cannot afford, and of course they might refuse to send my passport back to Canada. So my partner is going, and I'm stuck here, feeling guilty because I can't be there to support him, waiting anxiously for Sydney to tell me I'm good to go. My biggest fear is I won't make it in time to be with his dad.
Anyway, good luck with your appliction, I hope it goes really fast, there's nothing quite like the extra stress of feeling like you are running out of time!
