A colleague of mine had less than 1095 days. He was short by 3 days as he missed a trip to US during his relevant period. CO asked him during the interview that a trip is missing based on his stamp. He answered that he has provided details to the best of his knowledge based on all the information he had. He was not referred to a judge and got OATH letter in a month.

So even today(before C-24)it is the COs discretion to flag you for CJ review or not.

Up to three discrepancies and up to 5 (or 15) days missing If I am not mistaken do not qualify to get you to a judge as these cases are usually approved by CJs.. this info was based on the CIC internal Operational Bulletins .. this might change as this info was from last summer.
It is like if a person missed a vacation to Cuba as they do not stamp your passport.. it happens
