I have a friend who is a refugee still haven't get his hearing yet and wanted to file for inland sponsorship as his wife is a PR, I suggested him to Attorney here and his assistance said they will not take the case since his refugee hearing is pending, Why wouldn't they take his sponsorship case?
 
Because someone who filed for refugee status, and then files for PR, would appear to be someone who's really desperate to stay in Canada, and thus any marriage to a Canadian would be considered non genuine, and is primarily to stay in Canada. Basically, they won't take his case because it's a very good chance they will refuse his application.
 
So refugee whom married and apply inland will be refused? So how come I see post people do apply? All of them get refused?
 
Not all get refused, it's just a very very low chance he will win. I don't know what you mean by post people do apply, there are a few people here who had former refugee spouses and were successful, but they had to have had a very strong relationship background/evidence.

Let me guess, did your friend propose and marry his then girlfriend, after just a few months from the first meeting? Refugee applicant + quick marriage = almost guaranteed refusal.

Also it depends on the country he's from. Unless he's from a country where there's a good reason to apply as a refugee, such as Iraq, Somalia, Syria, North Korea, etc instead of "so-so" countries like Mexico (a very common one), Pakistan, etc, then his chances of getting deported are high. And when a person gets deported, their chances of being sponsored is almost zero, because they now have a history of being deported and applying as refugee.
 
They know each other quite some time and married after 10 months
Proof they have is pictures sms messages, he is from Malaysia
 
That's good, but why is he applying as a refugee from Malaysia? It's a flawed democracy, but I doubt he'll be successful with his refugee claim from that country.

Lol, this is also a sign of a possibly *gasp* good lawyer, and doesn't want to take a dog of a case with little hope of a positive out come. I would take a second look at what the lawyer said in their reasoning for not taking the case and see where you can mitigate any possible damages from that, before trying to simply find another lawyer/consultant whom would be happy to part the person in question from their money.
 
Mitigate DAMAGES!?!? Just for refusing to take a case!!! Good lord, this better not be in Canada.

I think what Dan was referring to is the applicant trying to overcome whatever reasons the lawyer listed for not taking on the case, I.e. try to use these learnings to strengthen his sponsorship case

TBH the only thing the lawyer told him is "since there is a refugee case pending its unlikely we want to take your sponsorship case as its complicated "
 
Even if you have not gone for your refugee hearing,it is legal to marry and apply for PR.There are different offices who process the application.Alot of people will prefer having their pr through marriage or any other means,NOT REFUGEE.Too much problem with refugee paper.I will advise you to go ahead and marry,Dont even wait for the lawyer,he did not want to do the marriage because he want u to fail at the refugee so that u can still pay him for the appeal.How ever refugee stay longer so that he can be taking money from the government.You remember ones the declared married the government will not pay the lawayer his legal aids.So go ahead and do your marriage.Refugee hearing is 10/100 positive.
