I would like to draw your attention to something valuable said by attorney David Cohen in the December-2008 article on his blog website. My questions follow his writing quoted below.
"Stating that there are 38 qualifying occupations doesn't really tell us that much. An applicant's job title isn't important, but rather the duties the applicant performs or performed are what matters. For example, let's say that your occupation title is "Software Development Programmer" (NOC code 2174), you might assume that your occupation is not on the list of qualifying occupations and that therefore you would be discouraged from applying under the Federal Skilled Worker category. But, as it turns out you spend 25% of your time on the job carrying out the duties of an Information Technology Manager (NOC code 0213) and you have been doing this for at least four consecutive years. You may now want to consider submitting a Federal Skilled Worker application because IT Managers are on the list of qualifying occupations."
He said 25% as an example. Or, was it really an example? If it was not, could someone please provide me the link to the source on the CIC website where it mentions such a figure? If there isn't any such figure mentioned on the CIC website, practically how low could the figure slide (i.e. 15%, 10%?) before being deemed ineligible for NOC 0213?
My NOC code is 2173. But, whether CIC believes or not, a year ago my company indeed made some changes to our job responsibilities to such an extent that our designations were changed and we ended up taking some common responsibilities, such as project budget calculations, risk analysis, pre-sales activities, etc., with telecom managers (NOC 0213).
Could someone please illuminate the dark room I am in? Thanks.
