Hello Everyone,

I would like to draw your attention to something valuable said by attorney David Cohen in the December-2008 article on his blog website. My questions follow his writing quoted below.

"Stating that there are 38 qualifying occupations doesn't really tell us that much. An applicant's job title isn't important, but rather the duties the applicant performs or performed are what matters. For example, let's say that your occupation title is "Software Development Programmer" (NOC code 2174), you might assume that your occupation is not on the list of qualifying occupations and that therefore you would be discouraged from applying under the Federal Skilled Worker category. But, as it turns out you spend 25% of your time on the job carrying out the duties of an Information Technology Manager (NOC code 0213) and you have been doing this for at least four consecutive years. You may now want to consider submitting a Federal Skilled Worker application because IT Managers are on the list of qualifying occupations."

He said 25% as an example. Or, was it really an example? If it was not, could someone please provide me the link to the source on the CIC website where it mentions such a figure? If there isn't any such figure mentioned on the CIC website, practically how low could the figure slide (i.e. 15%, 10%?) before being deemed ineligible for NOC 0213?

My NOC code is 2173. But, whether CIC believes or not, a year ago my company indeed made some changes to our job responsibilities to such an extent that our designations were changed and we ended up taking some common responsibilities, such as project budget calculations, risk analysis, pre-sales activities, etc., with telecom managers (NOC 0213).

Could someone please illuminate the dark room I am in? Thanks.

What I can conclude from this is:
Spend 25% for at least 4 years= 25x4years which is then=100%. Then you can I apply.

I cannot answer your question as this is a very controversial issue and point. Nobody is yet able to assertively confirm what the CIC means i.e do these NOC's 2147, 2171, 2173 etc come under 0213 or not. As an IT professional, I however know that all these NOC's could hold Managerial Posts as well as carry-out the managerial duties and responsibilities without any doubts.But, again, I am not CIC.

Yes and No.
Yes, because very few people will qualify.
No, I am of the opinion that as long as you can prove "One Year of Continuous employment" and carryout most of the job responsibilities as written on the CIC web site for a particular NOC that qualifies" then you should not have a problem qualifying for the award of points for Experience. But, again, One has to achieve a minimum of 67 points.

If I were you, I would give it a go, for all, you haven't got anything to loose (money wise). If you don't get through the first stage anyway, you are refunded your money unlike people like us who applied before the new rules.

I applied with NOC 2173 during Feb 2008 and i had just 4+ years experience. But my spouse also was working so we had those points too. I am done with the medicals and waiting for the next advise from CIC.

Check your points and you should give a try.

Hi everyone,
I filed for skilled worker application in Feb 2009 which got rejected due to non-inclusion in 38 categories (I selected my category from NOC list). However, I understand that my job do fit into one of the 38 categories.
Can I reapply my case giving the reference of past rejection?

thanks for the reply. I applied initially as ´Information system analyst´ (code no: 2174). However, this does not come under the ministerial list (38 categories).
I now want to apply as ´Information system manager´ i.e. code no: 0213. Can I reapply? Will my application be reconsidered as an amendment to my last application?
