Asylum information required

Hi all,

Would seeking political asylum due to the ongoing political tensions between India and Pakistan qualify as a reason for seeking asylum here in Canada? My uncle is Indian however, my aunt has a Pakistani passport.

They are currently living in UAE but their Visa is running out. They do have a TRV for Canada approved....How would they go about seeking asylum? Should they come and apply? Should they hire a lawyer?

Any assistance in this matter will be highly appreciated.

How long have they been lining in uae? It may prove difficult to claim asylum if they haven’t actually lived in India to experience any difficulty. The other thing to consider in application is the option for Internal Flight Alternative, which is often a reason for refusal. On the information you have provided, a successful refugee claim is probably going to be difficult to prove.

If they have been living in the UAE they have not personally been experiencing any problems. Problems must threaten their own lives and have proof that their lives are at risk.

Thanks so much for your input. They did visit India a couple of years ago and faced alot of difficulty right from airport official to police verifications.

Situation as of now have detoirated further politically. They are worried they might have to live seperately.

Thank you for your input. They face alot of issue when visiting either India or Pakistan for that matter.

How should they go about seeking asylum? What is the pocedure to be followed generally?

Have they looked at whether they qualify for economic asylum? An asylum request should only be done when there are no other options and you have the proof that you can not settle anywhere in your home country. An asylum refusal creates looks of difficulties for travel in the future.

Difficulty and political tensions are not grounds for an asylum case. They would need to show proof or official records of targeted persecution, threats, etc. that proves that they really can't live in either country.
