Arriving in Canada after 3 years of my landing

Hi,

I soft landed in February 2018. And I got my PR card a little late as the first two PR cards were never received. So the PR card I received bore an expiry date of September 2023. As I had stuff to take care of in the US, I spoke to at least 5 immigration attorneys on how long I could stretch arriving in Canada. ALL of them suggested that I could wait until September 2021 as I would have two more years left on my PR and to be a little cautious I could come to Canada a few months before September 2021.

I arrived in Canada in end of May 2021 only to be stopped by the CBSA officer and to be notified that I haven't met my RO. After a long interview process, I was admitted as a PR and with a "benefit of doubt" that I didn't know the 5 years starts from the day of my landing. (which I didn't). The officer told me, "I could have written you up if I wanted to, but I am not doing it. And I am giving you the benefit of doubt. But I will let IRCC know that you haven't fulfilled your RO. I am going to put scanned copies of our interview on your file."

What I am not clear is will I receive any order from IRCC? And could I travel to my home country if there is a need in the next two years?

Looks like you have been reported by CBSA for not meeting your RO. Nobody will stop you travel outside Canada though.

You’re not going to get a deportation order. However it sounds like they have made notes in the system and that could cause you problems if you leave Canada and return before you become compliant again. Travelling home wouldn’t be advisable.

And your PR card expiry is irrelevant to RO. It your date of landing that counts.

Essentially you shouldn’t leave Canada for 2 years because at the very minimum your file likely has been flagged. Avoid all the incompetent lawyers you consultant.

Unclear whether she has reported you or not. Ignorance is not a justification for not remaining in compliance with your PR obligations.. lots of ppl get in trouble for this so I don’t know why she would give you the “benefits of the doubt”. You clearly just came back to Canada yo avoid losing your PR, but I don’t think is your priority to establish yourself here in Canada. You can travel outside of Canada anytime, whether you can enter or not is another thing.

No deportation, but you’ve been flagged in the system . You may have caught a break, but you don’t want to push your luck by leaving.
If you are old enough to go thru the process of getting PR for a country , then it’s assumed you’d know the rules that go along with that status .

With “benefit of doubt” on the file for this entry, the OP won’t be able to use not understanding the requirements again.

It looks like you were out of your RO by about 60-90 days? is that correct?
