Arrested but not convicted

Hi All,

Im currently in Canada on a work permit. If i have been arrested for DUI but the charges have been dismissed am i safe to leave the country and return? I know im not inadmissible, but im concerned that the CBSA would refuse me entry again anyway. I have a valid ETA, which im assuming would remain valid and i wouldnt need to apply for another one as my eligibility for it hasnt changed.

Is this something i should be worried about? If i bring evidence with me that I went to trial and was found not guilty / charges were dismissed will this suffice to allow me entry in Canada as i have a work permit valid with over a year left on it?

No, you should not be worried. It's fine, as long as you are able to prove that you were not convicted. False arrests are a reality and that is why there is a justice system to prevent such false conviction and arrests.

A dismissed case does not necessarily mean a false arrest. A person with dismissed charges could very well have been guilty of the accused crime but there was insufficient evidence or some other reason that the judge decided the case could not continue.

Yes, but, once the judge pronounces a person not guilty, even due lack of evidence, the person is not guilty. Anyway, I was assuming that the OP was arrested falsely because DUI cases are not very hard to prove, if the law enforcement follows the standard protocols for investigation of such cases, also, justice systems love to make an example of DUI cases and do not DUI offenders scott of easily. Anyway, discussion for another day.
