I want to sponsor my wife but her family is afraid there might be issues when leaving and coming back into Canada. We're planning on going on vacation to her home country, and she'll be there for a couple months.

Are there any risks in applying now? They're worried that the border officers won't let her in because of a pending pr status?? I thought it was a weird worry. I know there's some sort of 3 year living in Canada thing to keep your pr, but that's separate right?

Anyone know of any issues with the above situation? I'm unable to find anything online.

Is she from a visa exempt country?

If she submits an Inland application (SCPLC), she is advised to remain in Canada during the process. Although leaving for a short trip (usually no more than a couple of weeks) is usually not a problem, it DOES become a problem if the CBSA officer refuses re-entry...which can certainly happen. For this reason, an Outland application may be best because if she is refused entry, her application will continue to be processed, but she will have to reside outside of Canada, obviously.

You could submit the application now (Outland) but she would need to provide solid proof of ties to her home country, if CBSA questions her to convince the officer that she will leave Canada if the application is not approved. You should Google `Dual Intent Canada' to get more info.

There is no `3 year living in Canada' requirement. The R.O. (Residency Obligation) to maintain PR status is 730 days within each rolling 5 year window, which is only 2 years. It does not have to be consecutive days.

Are you a PR? If so, you need to live in Canada to sponsor your spouse.
If you are citizen, then feel free to stay in your spouse's country and sponsor her while staying there with her. You just need to provide proof for intent to relocate/come back to Canada.
