Hello everyone.

I was removed from Canada 3 months ago under an Exclusion Order for 1 year. I would like to try to apply for Authorization to Return to Canada to travel there before the ban period is over, but the instructions on the CIC website are pretty confusing. It's not clear if I should include a Temporary Resident Visa application or not, because I come from a visa-exempt country. Am I required to do so or am I good just with a letter and all the other documents?

I'm not sure I would bother applying for the ARC. I would wait out the exclusion order and save yourself $400. Based on what we've seen here, CIC takes their sweet time processing ARCs for those with exclusion orders. If you submit it now, most likely the ARC will be approved around the time the exclusion order expires. But ultimately your choice. If you still want to apply, then yes - you would include the TRV application form along with the rest of the supporting document.

Wouldn't that also depend on the visa office? So I'm assuming TRV is necessary in any case you're inadmissible, even if you were not convicted of a criminal offense? But wouldn't the ARC be assessed during the same time as the TRV application?

The reason why I want to visit Canada is to get married with my girlfriend. I overstayed in the past because I came with my parents as a 14 year old, who tried to apply for H&C but were denied, and I was just following them without any control over their decisions, therefore I got the same removal order as them. CIC misplaced our files for 2 years, which is how much we were waiting for the removal process to begin... It sucks that because of my parents trying to apply, now I have an immigration record and I can't come to Canada to see my girlfriend that easily...
 
Inadmissibility and exclusion orders are two completely different things. You don't apply for an ARC if you are inadmissible - you apply for rehabilitation.

It really doesn't matter what the reason is for the exclusion order. We've seen people here issued exclusion orders for far less than you. CIC still generally drags their feet with the ARC processing - even for those who are visa exempt. I don't believe I've seen anyone here have an ARC issued quickly for a one year exclusion order. It's always taken the better part of a year.

But again, you can certainly try.

Oh, I understand now. I'm not inadmissible, I have the exclusion order. I just don't understand why they would still require a TRV application. Anyway, I'll definitely try and see how it goes, even a month or two less would be a huge difference. Thanks for help.

I'm not sure why you think that they would approve you after 3 month when they specifically issued a 12 month ban.
