Please help...
My work permit will expire this November 2014, my employer ask me to find a suitable NOC code for me and somewhat higher wage as well. When I send my application to CEC my NOC code was 1211 now
my employer applied me for NOC code 2253 (it's kinda promotion). I haven't received a positive LMO yet, but I'm confused with what is happening on my status here. BTW I have my AOR from CEC already since April 2014.
Question;
1.) Will my application from CEC get affected because I will change my NOC code? (I have spent more than 1 year on being a 1211 code, just to make it clear)
It should not affect your application because you're already deemed eligible for PR thus your AOR. CIC will do a background check with your employer anyway and your employer can properly explain this.
2.) I am hearing BOWP using an AOR will suffice the application, will that work for me? By using this BOWP process should I stay on my current 1211 code and not change to 2253?
You can start your BOWP on August 2014 - 4 months before your current work permit will expire (Nov 2014). You can do this online. The AOR is needed apart from other requirements http://www.cic.gc.ca/english/department/media/notices/2012-12-17.asp. I am to believe that you can have the other requirements with a breeze. No LMO will be required.
The BOWP is basically extending your current work permit until a decision has been made by CIC. Therefore you will still have you old NOC code (1211 in your case). Processing, based on the updates we have will only take you less than a month.
If you're planning to change to a different NOC code then you need to have a new work permit. For work permits are tied to the NOC codes. Under the federal law, you can't change position/title (lateral, demotion or even promotion) and you need to stick to the title for the whole duration of your work permit.
Now that your employer already initiated a new LMO, you need to keep an open line of communication with them for updates if they are already finished in interviewing applicants, if they already submitted the requirements to Employment and Social Development Canada, etc. By the time you have less than 2 months before your work permit expire and don't have a clear grasp of your new work permit, apply for the BOWP.
I am thinking that you will get your PR right before or right after yourk work permit expires based on the current trend.
