Hi Dears,

Is it possible that the asylum claimant receives a positive decision without hearing based on the B.o.C (I mean automatically while he was waiting for the hearing) ?

Any experiences?
 
I personally didn't have this experience myself, but I heard through other friends where exceptions can be made for some cases that rarely may not require a court and for which you would receive a positive decision.

that's really impossible and is not fair..
 
Yes, it's possible, I know 2 guys from Iraq have had their approval before the hearing, they been told to not come to the hearing and they applied for the PR now.
 
Yes it is possible.. According to IRB website

Furthermore, under a new process, certain claims identified by the RPD as straight forward will be scheduled for a short hearing before an RPD member. The expectation is that a substantial majority of these claims will be finalized at the end of the short hearing. The provision to grant refugee protection to certain claims without a hearing will remain.
