Requesting suggestions from senior members (Bryana, scylla and others)...

Background -
1) My wife and I have received our PR on Sept 2016. We did our short landing in Oct 2016.
2) I will be doing my permanent landing in Feb 2017. My wife will join me in July 2017.
3) My mom is a retired teacher and currently takes tuition. She has ITR returns for last three years. Currently payments are received in cash and deposited my us in her account on monthly basis.
4) My father expired in 2011 and I am the only child. No living grandparents to show ties for my mom.
5) My mom doesn't have any property to show ties. I have a property for which I plan to give her power of attorney before I leave to manage rentals etc.
6) My parents received 10 year multiple entry visa in 2000 for US but never visited.
7) I have done one year of my graduation from UK and my parents visited me for a week in 2005.
8 ) My dad has visited UK couple of times and every time had applied visa for my mom too. So my Mom received UK visa 4 times but visited only once. She also had a Singapore visa (year 2004) but never visited.
9) Schengen visa rejection in 2004. Does this need to be disclosed even if it was like 12 years ago?
10) She had applied for High Skilled Migration program of UK in 2003 and was rejected. Does this need to be disclosed even if it was like 13 years ago?

Application Plan -
1) I plan to sponsor my mother for a two week visit to Canada in April 2017. I plan to apply in Jan 2017.
2) Estimated cost of visit will be 3.5k CAD and I will show 25k CAD as funds to sponsor her visit.
3) Will show mom's last three year Income Tax returns (1.3K, 6K, 6K CAD income for last three years), her FDs worth 7k CAD and bank balance of 2k CAD.

Document check list -
1) Copy of my and my wife's PR card.
2) Sponsorship letter from me. Will a Affidavit on a stamp paper for this be more effective?
3) My financial documents (last 3 year ITR and 6 month bank statement)
4) Mom's financial documents (last 3 year ITR and 6 month bank statement)
5) Itinerary copy.
6) Hotel booking.
7) Dummy tickets.
8 ) Copy of previous visas received by my mother and stamp of entry and exit from UK.

Question -
1) As I understand it might be better to apply for TRV for my mother once I get a job in Canada. How true is this? Will there be significant increases in chances of getting TRV?
2) Are there any other means of showing ties to resident country?
3) My wife will not be a sponsor since I believe it will be an overkill so no financial documents from her. Any documents from her which can help?
4) Will it help if I transfer funds (3.5K CAD) upfront to my mother as part of her visit sponsoring amount. Will it help show seriousness in my claim to sponsor her visit?
5) To show regular current income and in future will it help if we get letter from 1 or 2 parents of children who come to my mom for tuition. Will a letter on plain paper be sufficient? Any additional documents which will help?
6) There is not much time left (just 2 months) but will it help if my mom starts taking future tuition fee through online transfer instead of cash?
7) Any other suggestions?

3) Will show mom's last three year Income Tax returns (1.3K, 6K, 6K CAD income for last three years), her FDs worth 7k CAD and bank balance of 2k CAD.

Document check list -
1) Copy of my and my wife's PR card. Add your and your spouse's passport copy
2) Sponsorship letter from me. Will a Affidavit on a stamp paper for this be more effective? Yes, from Canada
3) My financial documents (last 3 year ITR and 6 month bank statement) It would be prudent if you apply after getting job in Canada and having a house rented which would be sufficient enough to accommodate your family and a separate room for your mother. ITRs from India won't help at all.
4) Mom's financial documents (last 3 year ITR and 6 month bank statement)
5) Itinerary copy.
6) Hotel booking. See my reply on point 3. Attach tenancy agreement mentioning your and your family's names and no. of bed rooms to be rented out. Ensure that there is separate room for your mother.
7) Dummy tickets.
8 ) Copy of previous visas received by my mother and stamp of entry and exit from UK.

Add Driver's licence which you will get in Canada.
Add your pay stubs and your wife's after you get a job in Canada. And an employment letter.

Question -
1) As I understand it might be better to apply for TRV for my mother once I get a job in Canada. How true is this? Will there be significant increases in chances of getting TRV? More than significant chances.
2) Are there any other means of showing ties to resident country? Show some financial, social or emotional commitments your mom has back in India.
3) My wife will not be a sponsor since I believe it will be an overkill so no financial documents from her. Any documents from her which can help? Would considerably increase chances if she adds as sponsor along with you.
4) Will it help if I transfer funds (3.5K CAD) upfront to my mother as part of her visit sponsoring amount. Will it help show seriousness in my claim to sponsor her visit? No. Don't do that.
5) To show regular current income and in future will it help if we get letter from 1 or 2 parents of children who come to my mom for tuition. Will a letter on plain paper be sufficient? Any additional documents which will help? You can add it as a tie to India that she has commitment for the kids whom she tutors.
6) There is not much time left (just 2 months) but will it help if my mom starts taking future tuition fee through online transfer instead of cash? May help
7) Any other suggestions?

1) Yes it will be significant if you have a job.
2)
3) If she also gets a job, provide her employment letter and your marriage certificate.
4) Keep the fund in her account for at least 3-6 months
5) Doesn't seem convincing.
6)
7) Hurrying in application doesn't help at all, it will be a probable rejection as my parents had. So I would suggest take your time and build a strong application.

Hi,

IMO, your mom has very few ties to return to. So you'll have to work very hard to prepare a good application.

2) Sponsorship letter from me. Will a Affidavit on a stamp paper for this be more effective? Yes, from Canada
Apart from being a waste of money, this is not required for India applications.

6) Hotel booking. See my reply on point 3. Attach tenancy agreement mentioning your and your family's names and no. of bed rooms to be rented out. Ensure that there is separate room for your mother.
Not required. Just the address where you're renting is enough.

Add Driver's licence which you will get in Canada.
Not required.

Add your pay stubs and your wife's after you get a job in Canada. And an employment letter.
This is necessary i.e. your employment and salary details.

4) Keep the fund in her account for at least 3-6 months
A sure shot way to get a refusal.

To answer your questions:
2) Estimated cost of visit will be 3.5k CAD and I will show 25k CAD as funds to sponsor her visit.
In whose bank account will the CAD 25K be shown?

1) As I understand it might be better to apply for TRV for my mother once I get a job in Canada. How true is this? Will there be significant increases in chances of getting TRV?
You must find a job, get a place of your own.... before you apply for your mom. Your mom does not have a strong financial situation + as the host, you must have a job/home to support her visit.

2) Are there any other means of showing ties to resident country?
As your mom will visit in April (schools are closed in India), she cannot show a must-return-to-tutor-the-kids-for-exams reason. Can she defer her visit by a few months?

Does your mom currently live with you in your property? Or in a leased accommodation?

What are the clauses/obligations of the POA that your mom must do?

Is your property in a Co-operative Housing Society?

Does your mom do any volunteer or charity work?

Does she have any relatives who live in the same city?

Does she have any relatives who live in maybe the UK/Schengen countries?

Does she have any compelling reason to return by a specific date?

Is your mom an external examiner for some exam or does she evaluate any examination papers?

3) My wife will not be a sponsor since I believe it will be an overkill so no financial documents from her. Any documents from her which can help?
Any India-based reason why your wife will stay back until July 2017?

4) Will it help if I transfer funds (3.5K CAD) upfront to my mother as part of her visit sponsoring amount. Will it help show seriousness in my claim to sponsor her visit?
A big no-no.

5) To show regular current income and in future will it help if we get letter from 1 or 2 parents of children who come to my mom for tuition. Will a letter on plain paper be sufficient? Any additional documents which will help?
This will not help in the current situation because she is paid in cash + she plans to visit in April (school holidays).

It will help if she plans her visit when the schools reopen.

6) There is not much time left (just 2 months) but will it help if my mom starts taking future tuition fee through online transfer instead of cash?
It will help tremendously. She can accept payment by cheques.

9) Schengen visa rejection in 2004. Does this need to be disclosed even if it was like 12 years ago?
10) She had applied for High Skilled Migration program of UK in 2003 and was rejected. Does this need to be disclosed even if it was like 13 years ago?
It is absolutely essential that she discloses any previous visa refusals for any country

Cheers

dear i aslo applied for my Mother TRV but it was rejected Twice..and ive applied it again i hope il get it this time,

1.Send her your Bank statement, job letter from your company,
2. and also put some cash 5-8k $ in her account as well.
3. make a good invitation letter.
4. good letter for explanation from her side to the Visa officer should be simple and to the point . coz they have tons and tons of applications and it should not be too long just simple and to the point.
5. attach return ticket with her letter of explanation.
6. it is a plus point if she has any travel History.
7. and state how much time she is planing to stay there , i gues 2-3 week is a very short period given that you are coming all the way from India spending 1k$ on ticket. so mention 4 month at letst in this case the visa officer will know that you arnet lying.

and yes most impotanlty why do you need to put cash in her account is because they should know, that your mother can bear her own expenses.

good Luck

Considering the suggestions you have given,, the OP's mom could get a TRV refusal

Thanks Bryanna. here is some more info regarding my situation.

In whose bank account will the CAD 25K be shown?
- 25K will be in my account since I will be sponsoring.

You must find a job, get a place of your own.... before you apply for your mom. Your mom does not have a strong financial situation + as the host, you must have a job/home to support her visit.
- Point taken :)

As your mom will visit in April (schools are closed in India), she cannot show a must-return-to-tutor-the-kids-for-exams reason. Can she defer her visit by a few months?
- Yes. Isn't it better she will be visiting when schools are closed so it doesn't impact tuition?

Does your mom currently live with you in your property? Or in a leased accommodation?
- My own property is rented out. We stay in different city in a rented place. My mom stays with me. Will it have an impact if I were to transfer property in her name? How significant ? How is property even a tie? Can't a person leave a POA and have it sold once in Canada?

What are the clauses/obligations of the POA that your mom must do?
- This is yet to be done. It will be more on the lines to allow her to rent out and collect rent. Pay taxes and society maintenance etc.

Is your property in a Co-operative Housing Society?
- Yes it is a society.

Does your mom do any volunteer or charity work?
- No

Does she have any relatives who live in the same city?
- Her younger sister and couple of cousins.

Does she have any relatives who live in maybe the UK/Schengen countries?
- No

Does she have any compelling reason to return by a specific date?
- Not right now. But if there is a marriage in family, does it count? Uncle's (dad's brother) son marriage?

Is your mom an external examiner for some exam or does she evaluate any examination papers?
- No

Any India-based reason why your wife will stay back until July 2017?
- No. We just don't want both of us to leave job at one go. Our plan is for me to go and find a job and my wife will follow in couple of months.

It will help tremendously. She can accept payment by cheques.
- Specifically cheques or online transfer will do? What is the difference if it has to be cheques?

Our short term end goal is to apply for a Super Visa. From this forum I had gathered it is better to apply for tourist visa, visit Canada, come back to home country and then apply for super visa. How true is that in your opinion?

How long should I wait after getting a job to apply for super visa or TRV?

Will it help if my mom were to go for a 1-2 week's holiday to UK or US and then apply for Canadian TRV/Super visa?

Hi,

- 25K will be in my account since I will be sponsoring.
Your mom must prove that she can pay for the visit with her own finances.

Yes. Isn't it better she will be visiting when schools are closed so it doesn't impact tuition?
Not at all. The situation would've been different if your mom had a registered coaching/tuition business.... with well-defined batches + coaching schedule.

Your mom runs home tutoring classes.... she is paid in cash. Another variable factor: Students are not fixed/not 100% guaranteed to attend when the new academic year begins in June 2017. This does not help to prove her employment ties.

Wanting to visit in April (when schools are closed) means she cannot prove her employment ties + it appears she wants to move with you to Canada.

- Will it have an impact if I were to transfer property in her name? How significant ? How is property even a tie?
You may want to read the backgrounders/similar points on the CIC website regarding property/other strong ties.

Can't a person leave a POA and have it sold once in Canada?
It would be very unusual if a POA gives someone the right to sell/transfer a property.

Does she have any relatives who live in the same city?
- Her younger sister and couple of cousins.
This wouldn't help because I assume they are married/live with their families.

But if there is a marriage in family, does it count? Uncle's (dad's brother) son marriage?
Yes, it counts.... if it is scheduled after her visit.

From this forum I had gathered it is better to apply for tourist visa, visit Canada, come back to home country and then apply for super visa. How true is that in your opinion?
It is possible to apply first for a super visa (and not for a TRV) if one is eligible.

How long should I wait after getting a job to apply for super visa or TRV?
To apply for a super visa, you must meet LICO i.e. prove that you have the finances to support your mom's stay besides other eligibility conditions.

Regardless of a TRV or super visa, your mom must prove she has strong ties to India.

Will it help if my mom were to go for a 1-2 week's holiday to UK or US and then apply for Canadian TRV/Super visa?
Yes, it will help. Alternatively, she can plan a visit India >> Canada >> US/UK after she gets a US/UK visa

Cheers

One question: why is it so bad for him to give money to his mother? If he's inviting her and paying for her expenses in Canada, why is it so bad? (I am asking because I have a somewhat similar situation).

It's not "bad", but it is harder to prove one's ties to their home country if they do not have sufficient funds in their own name.

A good TRV application will show that the applicant will return to their home country because they have ties (money, property, family) to return to or they have the means to do so. If a Canadian host is shouldering the brunt of the cost because the mom has no money of her own, then there is a greater risk of overstaying (slippery slope logic, but this is how visa officers think).

Ah. I see. I am asking for my husband, who is a PhD student in our home country. I am a student in Canada. I want to invite him and he has to go back to his studies so I thought that giving him money from my Canadian account would be a good way to go.

It's not impossible, but only a bit tougher if he doesn't have enough funds in his own name. He can still apply, and you can still show your funds to support him. Rule of thumb is to show $1000 per week of stay plus airfare.

$1000 per WEEK? But he will live with me in the apartment that I rent in Canada and I have a TAship. My monthly salary is around $2000 so why would they ask for him to have $1000 per week?
