hi all:)

i have been in canada for almost 4 years now (visitor->working holiday->study permit), came here originally to be with my girlfriend and now fiancé.
now that we're engaged we want to do the family class sponsorship and I am trying to figure out if it is possible to apply through vienna from within canada?

a friend told me that it might go a lot faster. would i just use the documents from here ("If you are applying from outside Canada") cic.gc.ca/english/information/applications/fc.asp and send them to vienna, although i am already living with my fiancé in canada?

or should i use the documents from here ("If you are applying from inside Canada") cic.gc.ca/english/information/applications/spouse.asp and just send them through vienna?

also .. i applied to extend my stay in canada in the beginning of july, to renew my study permit (the program takes me a little longer) .. i am still waiting for a decision there. now can we submit a family class sponsorship application before that application is processed or do i have to wait?

thanks for the help

p.s. i am from germany and she is canadian

Re: applying through vienna while living in canada possible?

ok i wish i had first looked in the sticky thread "spousal sponsorship" in this board. it answers one part of my question: yes i can apply through vienna.

but still - which application package should we be using .. from inside canada or from outside canada? and do we have to wait until the study permit application is processed?

edit
also it says the processing time for vienna is 11 months right now. applying from inside canada is only 8 months according to cic.gc.ca/english/information/times/perm-fc.asp

so it seems like now from inside would be faster? or is 8 months not really accurate?

Re: applying through vienna while living in canada possible?

You can apply inland and outland, i would recomedn to apply outlansd because you can leave Canada and it is fatsre process than inland ,
i8f you are applaying inland you are not aloud to leave country Canada , if you leave your visa can be denied,
just put the documents outland and extend your stay , it is faster and easy .
Check also Vienna Thread
Good luck

Hey,

I am in canada and applied Outland, it's faster and like Europe said, you can leave if needed. Also, you can appeal if it is denied. (I am 99% positive on that, anyone please correct me if I am wrong)

The only downfall is, if there is an interview needed (if they don't believe the relationship is genuine etc) you might have to travel to Vienna. This is what I have heard from people who are not in canada, I haven't heard of someone being in canada, applying Outland and needing an interview, but I assume it works the same.

awesome. thanks for the info

so if i do apply outside canada do i still use the application package for "applying from outside canada" although I am in canada already?

just wanna make sure i don't fill out the wrong one and then have to do everything again ;D

edit
a friend of mine applied inland and the cool thing about that was that he got his work permit after 6 months already, but processing the whole thing took more than a year

Yeah you're right, you still use the Outland forms. I do have a consultant and he got all the forms ready for me so for info on that you will have to ask some people in the Vienna thread, messenger for example.

For me personally, it's a complicated case and my consultant said Outland would be my better option. We also discussed maybe doing inland and including a work permit but I chose to do Outland. Where abouts are you in Canada ? You can give my consultant a call, he's in Toronto and gives some free advice over the phone. He's awesome!

you mean not allowed to work until my application is processed and i get my papers right?

maybe it's worth paying somebody to help with the application. i thought i'd do it myself and save the money, but on the other hand having somebody walk you through it would be nice :)

You would be surprised with all the information you can get on here haha. But yes I think Europe means you can't work without a work permit of course. And like I said, I paid someone and it made a world of difference. I would have definitely screwed up if I didn't have my consultant !
