You can try applying - however the chances of refusal are very high due to the failed H&C application. I would recommend waiting a few years between the H&C application refusal and the super visa application. Your parents will need to demonstrate that the have re-established very strong ties in their home country and have no plans on remaining in Canada long term. It will likely be challenging to get an approval regardless of when you apply.

Supervisa is also not a longterm plan. If one parent gets sick or can’t pass the medical your parents will be asked to return home one they are stable. Supervisa only covers emergencies not longterm care for illnesses and 100k doesn’t go very far. You also need to be making alternate plans for your parents. I assume this means that H&C was unsuccessful and their medical insurance ran out a long time ago.

They can apply but there is pretty much no chance of approval. That's the risk of applying for something like H&C.
 
Unfortunately people are very quick to apply for H&C. Many communities encourage the application as well. Nobody talks about the longterm consequences and that people get refused.
 
Hi, me, my wife and 22year old son are PR holders. My widowed mother , 89 years old staying with me in Canada. I have applied for her stay extension once. There is no one in India to take care of her. Which is the best option for me to keep her in Canada? Super visa or H&C.
one point- her case under H&C will get weakened if we travel next year for my daughter marriage next year.

Are you an only child or do you have siblings?

If you want her to apply under H&C, then she needs to be prepared to remain in Canada without leaving until the application is processed (which could take 2 years). Yes, leaving can weaken the application and she may also have issues returning to Canada after leaving.

Do you meet the LICO requirements to sponsor her under PGP? That would be the best option once the program reopens this year and if you are selected through the lottery as a sponsor.

My friend got super visa for his parents in 2.5 months. I want to do it so that next year I do not face any difficulty in my travelling to India with my mother for my daughter marriage in India. In that case I would definitely not apply under H&C. H&C will have a very low chance of succeeding if you have 3 siblings in India. And if she applies under H&C and is refused, that will create issues with future travel to Canada for her.

I would recommend you apply for the super visa and then also look to qualify and apply to sponsor her through the PGP program once it opens.

Note that a super visa is still just a visitor visa and does not guarantee entry into Canada.

True, she has a visitor visa till 2028 and one question if I travel to India now, gets super visa, she can travel back to Canada?

She can certainly travel back to Canada - however if and how long she is admitted to Canada is always up to CBSA. A visitor visa or super visa do not guarantee entry.
