Applying Spouse papers from outside Canada

Hi:
I am a Canadian citizen currently working in US on TN Visa, my employment status in US is temporary (contractual). My wife is a Pakistani citizen and she got her US visa 2 months ago. Currently she is here in US.

I am planning to file her sponsorship papers from US (Buffalo). Since i am residing outside Canada, i am not sure whether i can file her papers from US or not. I did checked out cic website and over there it's mentioned that one can file spouse sponsorship papers from outside Canada provided that both will move to Canada once spouse receive immigration.

I am not sure whether this is possible or not, looking forward for guidance.

According to section 130(2) of the Immigration and Refugee Protection Regulations, a sponsor who is a Canadian citizen and does not reside in Canada may sponsor their spouse, common-law partner, conjugal partner or dependent child who has no dependent children if the sponsor will reside in Canada when the applicant becomes a permanent resident. Therefore, as you are currently living in USA, you will be able to sponsor your spouse as long as you can prove that you will return to Canada once your spouse acquires permanent resident status in Canada.

As a Canadian citizen you can file from outside Canada, however you do need to show proof of your intent to resettle in Canada.
Processing through the Islamabad office can take quite some time, 70 days at Mississauga plus 24 months in Islamabad.
She will not be eligible to be processed through the Buffalo office (11 months) until she has been admitted legally to the US for 1 year.

Thanks a lot for your reply. Do you happen to know that how do you show your intention that will move to Canada once applicant becomes permanent resident? Currently my whole family is in Canada and secondly i am on contract over here. Can these two points go in my favor or i need to look for something else?

They'll help but won't be enough. Get a letter from your employer stating you are on contract and will be returning to the Canadian branch to work later on (if that is the situation). You can detail your and your wife's employment plans once in Canada, and state where you will be staying. Attach any proof of this you can get. Letters or affidavits from family members and friends who know of your plans can help, especially if they say what kind of assistance they will be giving you when you move to Canada.

Hi there, i am the same situation for my wife, plz share your experience with me..
Also, i am canadian citizen and holding TN visa but my wife is pakistani citizen and not have any canadian PR status.. so please share your expereince in which visa you bring your wife in to usa from pakistan.
