Applying for TRV with Spousal Sponsorship in Progress? Yay or Nay?

My mom got a multiple-entry visa valid for 4 years even though her passport expires in 6.
I assume the validity of the visa is trully discretionary.

Thanks Missmini. We were very shocked. I inparticular had a mini nervous breakdown outside of the embassy. I was nervous from the get go, but I'm a nervous person. My fiance kept saying he feels good, that everything is going to be ok, and that he can't believe that they'll deny him the trv this time since he got it the last time and we provided the same proof as before.

I don't know if we should try again. Should we wait until after we're married? (July 7, 2012) and that way I have to be put on the family extra information form and they will see that we live together? I always thought it would be more difficult after we were married. Should we just apply for a single entry? We were trying for the multiple entry, maybe single is easier? (although it shouldn't matter after he's already proven himself...). I will be moving back to Canada at the end of August and submitting the PR application from there. Should we mention that? Either way his intention is NOT to live in Canada until he is granted PR. It will be for short visits (2 to 2 1/2 weeks long). It was meant to make the wait for PR more bearable because it will be less expensive for him to visit me than for me to visit him and plus, I'm a teacher and am limited to Christmas (HELLO EXPENSIVE IN DR!) and March break (also very expensive because they are peak travel times for a Caribbean vacation) so he would be able to come here in the "off" months for the visits inbetween so we wouldn't have to be apart more than 2 1/2 months at a time.... I don't know if we should try again or just suck it up and suffer through the PR wait time. For DR it's posted as 15 months long. Some people are lucky and get through in around 6 months, but the majority are around 9-12 months.... after living in DR for the past 3 years (we've only been living together since February due to work situations), it will just be so ridiculously hard. I was really hoping we could make it a little easier on ourselves.

If we do decide to try one more time for a TRV before I leave, should we mention the dual intent? Or should we not because we won't be sending the application in until the end of August or first week of September (once I can finalize the package and print off the final photos). I guess it's a crap shoot. But is it worth one more shot?

i really don't know :( .....if u do apply before getting married it would mean around now and if the circumstances r the same then it might b the same result....and after that yeah it might b harder since as u said u r married already (i thought they already knew u were living together)

my mind is twisted abt this trv process too (today one thing makes more logic and tomorrow anothet one)....i thought single entry is easier and then once u got that once u can apply for multi; now i don't know multi would mean u intend to leave at least the first time ??? in ur case if multi was not successful but single was try single, who knows ???

i don't know ur situation exactly but if u can do stay togethet throughout the process (at least for a while)....the separation is really hard

there's no point in mentioning dual intent....even if u don't they know it's a possibility to b there.....so i really don't see how that would help, maybe i'm wrong....but once the sponsorship starts u need to say it and show the sponsor approval and yeah that's like mentioning dual intent cuz u don't have a choice....

but in any case do try later u never know ::) when later: just do as ur instinct tells u to :)

Read the whole thing, but a couple of selections follow for easier discussion in the thread:

"A22(2) states: “An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.” Dual intent is present when a foreign national, who has applied for permanent residence in Canada also applies to enter Canada for a temporary period as a visitor, worker or student. Dual intent on the part of the applicant is therefore not prima facie grounds for refusal of temporary resident status."

"An applicant applies for a temporary resident visa (TRV) to visit Canada but is denied solely because they have a family class application for permanent residence in process. In the refusal letter, the officer states that because the applicant is pursuing permanent residence, the officer is not satisfied that the applicant will leave Canada at the end of the period authorized as required by A20(1)(b). The officer has made an error. A22(2) precludes denying an application for temporary status on the basis that there is an outstanding permanent resident application, if the officer believes that the applicant will leave Canada at the end of the period authorized for their stay. If the permanent resident application is finalized after the issuance of the TRV, the applicant would be authorized, on the basis of the permanent resident visa, to remain in Canada."

From what I know, (and I don't know much, as I am not an expert) you can only extend for another 6 months, and that might not be even enough for you before the Immigrant Visa comes out!

Congratulations! You must be very happy.

Take a look at http://www.cic.gc.ca/english/visit/extend-stay.asp for detailed instructions. If you decide to extend her stay, you'll need to apply latest 30 days before her current stay expires.

Will it effect in any way my spousal sponsorship application if she stays for greater than 6 months, of course only when her extension is approved.

If the extension is approved, it will not hurt her PR application in any way. In fact, the proof that you two are living together will help it - it goes to show the relationship is genuine.
Applying for several TRVs and other visas and having them refused, and then applying for a PR looks bad. An accepted TRV is fine.
