Applying for TRV before or after spousal PR application

Hello,

I know there are some old posts that somewhat relate to this question, but I would greatly appreciate if (especially senior members or those who have had a similar situation) can give their recent advice/opinion on the following.

I got married last month and I am now back in Canada and am planning to sponsor my wife to come to Canada with an outland application. Given the long wait times, I also like to apply for her to visit me using TRV, for at least a short stay like few weeks. I have heard that almost all such applications for TRV "after" applying for a PR sponsorship have been rejected for obvious reasons such as having a PR application in process.

I also received an advice that it would be more successful if my wife first applies for TRV right now (with all the convincing evidence that she will return due to her job), and then within a week (and before hearing back about the status of the TRV application), I apply for the PR application by sending the documents to Mississauga. The idea for this is that the officer processing the TRV does not see a PR application in process (i.e. the sponsor evaluation part has has not even started). In addition, it has the advantage that when filling out the PR application, one can be honest in saying NO to the question whether any previous visitor visa applications have been rejected, because you simply dont whether it has or not. the person advising me went down this route and they were successful. They are still waiting for their PR while being together in Canada.

I am however not completely certain whether this is completely a good thing for me to do and whether it can in any way jeopardize our PR application, if the TRV is rejected, or even if such multiple applications exist with the said timing of filing htem. I am having difficulty choosing what to do as I can apply for TRV either 'before" or "after" at the moment. My questions are:

- Is it really a better idea to apply for the TRV just before sending in the PR application? Does it really have a higher chance of success?
- If the TRV is rejected, can that negatively affect the PR process at any of its stages, raise warnings, cause delays, etc...?
- Is there any reason why almost everyone applies for TRV after their PR application, and not this way if it has a higher success?

Any other advice regarding the TRV+PR situation and their timing is most welcome...

My fiance and I discussed the TRV thing in length, and we both agreed to try for it AFTER the PR application. The reason is if you look at one of the PR application forms, it asks a bunch of "red flag" questions such as have you ever been arrested, applied as refugee, been involved in genocide, etc. One of those red flag questions is "Have you ever been refused a TRV?". We DO NOT want to give CIC any reason to doubt our application and it's clear a TRV, even if it's a small stain on our application, it's still a stain nonetheless, so we decide to apply for TRV after the application.

Even if they knew we were married, I know there are some people here who were successful because of their spouse's strong background. My fiance has the following things going for her:

-She's a Vietnamese citizen (they cannot obtain visas to affluent countries easily), but has travelled to Thailand, Singapore x 2, USA (stayed for a year for school), China, and Malaysia
-She has no family in Canada, however she has relatives living in USA, Australia, Netherlands, France (dont know if that's a bad thing if they're not from Canada), she has her sisters, parents, grandparents, cousins, etc living in same city as her. She lives with her parents and sisters and nieces.
-She has a 7 days/week, 8 hr a day job, at least $5000 in bank account

I feel at least, she has a much better shot at a TRV than 99% of Vietnamese because not many of them have a strong travel history like hers. But we know because we will be married, that will be a big drawback for her TRV application. However, we plan to write a letter to them, stating that we do not plan on jeopardizing our PR application by allowing her to overstay her visit in Canada by even just one day, and pointing out that she has travelled to the USA before and left on her own free will.

Also we plan to state that because I've visited her twice already, stayed 2 months during each visit, we feel it's only fair that she can come visit me for 2 months as well.

IMO, I know some people here say, it's a good idea to apply for a TRV before PR, because it will show them your spouse is making an effort to try visit you, but honestly, if that was such a good thing, they wouldn't have listed the "Have you ever been refused a TRV?" as a red flag question on the application. When you sponsor someone, you only get ONE chance to do it, you do not want to risk having a long processing time due to an impending interview, or stain your application in any way, so I feel you should try a TRV after you apply.

It's very high risk/high reward. If you apply TRV before PR, your chances of success is higher because you're not married yet presumably, but if the TRV fails (and I'm sure TRVs have a high rejection rate), then you will have to state on your PR application that your spouse was refused a TRV before (red flag question).

If you apply after PR, the chance of rejection for TRV is much higher, but at least when it is rejected, it won't affect your application, because you had already submitted it.

On our PR application, one of the questions asks, Has your spouse ever come to visit you? We will have to answer no, and they ask "Explain why", we plan to state that we do not want to risk a TRV being rejected and having that compromise our PR application. She is from a non visa exempt country. Also, whether I visit her, or she visits me, it doesn't matter because if she cannnot visit me, then I will visit her. I hope our plan to answer that question is good.

I am not sure I can advice you about the timing (before or after the PR) but as I understand even if she applies before the PR application you will have to write an Invitation letter where they will see she is your wife, they are very careful about these cases, she could be denied TRV in this scenario as well. From what I've heard if TRV is denied during PR process it does not affect the outcome of PR, these are 2 separate processes.

My experience: I applied for a TRV a month ago, at the same time my husband is sponsoring me, we applied back in February. VO Vienna processing times are getting longer and longer, he already visited twice and cannot come again because of his full time job. Look for DUAL INTENT procedure to get more info about what is important to emphasize in your TRV application.

I believe a letter we wrote explaining the circumstances played a crucial role (why he cannot visit me again, that we just want to travel, spend holidays together and celebrate our marriage anniversary, that with the prolonging processing times we might not see each for sooo long, that I understand I have to return to my home country after that of course, that we would never jeopardize the PR process in any way, provided proof of my ongoing Master studies, ownership of car, land, bank accounts, scholarships... all ties to my home country - in her case letter from employer stating the date she has to be back for her job would be of great help, along with the return flight ticket of course). I also showed a solid travel history, and was granted 2 TRVs for Canada before. I did work very hard on the application but it was worth it - I was approved in less than 2 working days (applied on line) !!! I couldn't believe it myself! So it's not impossible!
