Applying for the Work Permit under the Live-in Caregiver Program

Hi all,

This is regarding to the application of the worker permit under the Live-in Caregiver Program (LCP).

My friend is currently in Canada taking his 6 months training program in Edmonton as required by CIC to qualify under the LCP. He has an employer willing to sponsor him and will obtain the LMO so that he can apply for his work permit. He is a Japanese Citizen so once he finishes his course and has a positive LMO, he wants to go back to Japan and apply for his work permit under the LCP.

Since work permits are processed in Manilla, it takes many months and they have their own special criteria for processing them because of the huge demand for Canadian LCP work permits from Filipinos. So I was told that it will be quicker for him to apply elsewhere...like US or London, England, as processing times in the Philippines can take up to 18 months. On the other hand, I was also told that since he was a Japanese Citizen, processing times would be faster than work permits being processed from Filipinos living in the Philippines...so the 18 months wait normally doesn't happen. Has anyone heard of this or know if it's okay for him to apply in Japan. It's just that he needs to go back to Japan after his course to so it makes sense for him to apply for his work permit rather than go to another country.

Also, someone suggested that he takes his ILETS because it will be better to submit his ILETS score along with is work permit application as proof of his English proficiency. If that is the case...what is the acceptable score to show his proficiency...would it be 6.5? I know that ILETS score of 6.5 is the minimum required to immigrate to Canada.

Hi.. i will try my best to tell few information that i know.

-He can go back to Japan and can apply for work permit via ONLINE APPLICATION which is i believe is directed to the CIC in MANILA. (I can say that online application is way faster than mail in. Im an online applicant by the way.) He's not also allowed to send his application to other countries if his country of current residence is Japan. The application will be refused and be sent back to him coz of wrong visa office. His application must and can only be sent to Canadian Embassy in MANILA.

-processing time now in manila under LCP is so much faster than before.. i'm a member of a group in facebook under the BATCH 2014 (LCP VISA APPLICANTS) and most of their timeline is really fast. There are applications approved in less than 3 months.. most of them took 4-5months to be approved.

-they also require you to pass the SPEAK TEST. Its is their way of evaluating your english proficiency and also your knowledge in care giving. So i think IELTS is not required. But if he has a previous IELTS he can include it in his application.

I didn't know that you can apply for a work permit under the LCP via online. I like that option as I think it will be faster. It's good to know that processing times from Manilla is much faster than before. I have heard nightmares that it could take up to 18 months for the approval of the visa so that is why so many Filipino go overseas like Hong Kong to apply under the LCP.

Is the Speak Test required regardless of which visa office you applied within? Do you know where he has to go for the speaking test? Does he have to go to Manilla visa office or can he take the speaking test in a government office located in Japan?

If your friend is already in Canada now he can submit his work permit application at VO New York which handles work permit application to those who are already in Canada. He dont need to go back to Japan just to apply for his work permit. He need to submit a mail application and it takes at least 4 months. Once he received his letter of introduction he can cross the border to get his work permit outside Canada. -im from philippines but currently working here in saudi... so my application was directed to Riyadh Canadian Embassy.. and yes im an online applicant under LCP.. i prefer online application coz you can easily track and see updates regarding your application and it doesnt require you to submit hard copy of your docs... only scanned copy and upload the in you MyCic account.. you can read the steps regarding online application in the CIC website..

-i'm very confident to tell you that the process in manila is a lot faster now (2014).. most of their timeline is 4 months..

-i do not have much information regarding the speak test coz it is not required here in saudi.. there are some differences in the requirements from where you are going to submit your application and speak test is on of them..

-i will try to ask my forum mates about the speak and i'll come back to you.

-you can also consider the things that PUDDEE mentioned that might me another way..

Hi, pinkulotz.

You've shared such a good news and a lot of information. Thank you very much.
So much has changed since I applied many years ago. It's a good thing that online application
facilitate the process and save the applicant from spending too much by not seeking assistance.

How about the temporary resident visa, did you also apply online? Do you have to
pay separately since in Manila (mail-in application) the fee for visa is already included in work permit
with a total of $155 or Php 6,305 as of February 6, 2014?

Hi. I cant replay to your pm.. it said that your inbox is full so i cant send my replay.. anyway eto yung sagot ko..

If may visa ka na at umuwi ka sa pinas there's no need for speak test na. Pero once na umuwi ka ng pinas eh you still have to complete all the requirement ng Phil. Govt. Before ka makaexit ng pinas going here. You and your employer need to process the so called POLO requirements.. you have to complete PDOS, COA, DOLE and OWWA requirements by POEA. Be ready for the payments na hindi bababa ng 10K.. you need to process your OEC in POEA too.. and be ready to wait, pila and follow up all those thing for atleast 1-2 months bago ma.complete lahat.. so if i where you just go straight here and saka ka na lang umuwi ng pinas for vacation when you already got here.

Firstly, before I complete the application for my CIC, Am I
required to find an employer? If yes, can you provide
any methods to finding employment within Canada?

Secondly, is it easier to find work in certain provinces?

Hi all,

I will be hiring a nanny under the old Live-in Caregiver program as my LMIA application was submitted before November 30, 2014. I need help in clarifying a few things when he applies for the work permit.

He is a Japanese citizen but currently he is in Edmonton, Canada on a study permit. He is taking the Live-in Caregiver Program from November 1, 2014 to May 29, 2015. Since he is already in Canada on a study permit, can he apply for a work permit within Canada? If he can, then the work permit application form would be "IMM5710E - Application to Change Conditions, Extend My Stay or Remain in Canada". Or does he need to use "IMM1995E - Application for Work Permit Made Outside of Canada".

Also, is it better to apply via Federal Express to the VAC office in New York or is it better to apply online? I hear that applying online is much faster but if he does apply online, will it be the Manila visa office that is responsible for his application even though he is in Canada? Or does it get directed to the visa office in New York since he is already in Canada. I hear that the speak test is a requirement with the Manila office and it just doesn't make sense for him to have to travel to Manila for a speak test when he is in Canada. So I want to make sure that it's the New York visa office that will handle his application.

Anyone with any insight, it'll be greatly appreciated :)

i just want to enquire if anybody here also experienced or knew someone who had a refusal of application for LCP?
i submitted my application August 2014, received a confirmation letter last September 29, 2014 and received a corresponce stating they are refusing my application for the reason that "they are not satisfied that my employer would be able to provide me with furnished and private accommodation in the household. it is based on the document submitted. their household configuration, the number of members in the household and number of bedrooms in the house"

what do you think is the best next thing to do?

by the way, my employer is my sister in law...
