Its me again :p Im sorry for all the 100 questions I have but you guys are being such a big help!
My current visa(working holiday)expires May 1st. I applied for a new visa(plain visitor visa) on March 28th.
My bf and I were gonna apply for my PR on May 1st since thats when we started living together a year ago.

Now I got two questions :
I probably wont have my new visa by then(the internet says theyre now working on February applications) so Ill be here on implied status. My question is : can I still apply for my PR ?Or do you have to be visitor, temp.worker etc? Am I still eligible to apply for PR ?

The other question may sound weird but :
Like i said my visa expires May 1st. Does this mean i loose my current temp. worker status on May 1st or May 2nd? If its May 2nd I was thinking about getting my application for PR to CIC on May 1st. Does the implied status begin once they receive my application in the mail or once they open it?
If its once they receive it my bf and I are thinking about driving to Alberta and then bring it to a courier there to make sure theyll receive it the same day.
So they would receive my application May 1st, while Im still on my current visa & then Ill get implied status?
What if I then a few weeks later get an answer on my new visitor visa and they refused it? Do I have to
leave or can I stay under my "PR implied status?"

I know its a little complicated but hopefully you know what I mean :p

Oh really? That is great!

Okay so if I apply for my PR while Im on implied status(waiting for my visitor visa) and then I dont get my visitor visa(for whatever reason) do I still have to leave Canada or am I then allowed to stay in Canada because Im under the implied status for waiting on my PR?
Chances are very slim that I wont get my visitor visa but just making sure :p

Please don't take any of this as gospel as I am not an expert in this, but no one else has responded so here goes...

As I understand it you are fine to apply for PR while on Implied Status. I don't think you even need to have a valid status when you apply.

However, as I understand it, outland PR applications don't trigger implied status as you haven't technically applied for a work permit. If you were applying inland and filed for an open work permit at the same time, then you would, but the application would have to be received by CIC before your current work permit expires. Which makes things difficult if you haven't been living together for 12 months until that same date.

Now all this is only an issue if you want to keep working - if you're happy to stop working when your working holiday visa expires, you're totally fine to apply for your PR in May and stay as a visitor. If your visitor's visa was to be denied for some unlikely reason, I would think you would have to leave the country and wait out the PR in your own home country.

If approved, you can extend the visitor's visa if necessary until the PR comes through.

Again, I may be completely wrong, but I've done some reading on the topic as my work permit also expires in the beginning of May and my PR is not yet through. The whole implied status thing can be tricky and the work permit boards of this forum can be helpful to understand it all.

Hopefully someone else will weigh in soon with more help. :)

Good luck!

You're fine on Implied Status until you hear a yay or nay on your visitor's status. If it's a nay, they will give you a timeline to leave, although if you had an IEC visa, you're probably from a visa exempt country - so it's likely to be approved.

Outland PR gives no Implied Status. You must maintain status independantly.

Inland PR (the one where you're not supposed to leave Canada) gives Implied Status if you also apply for an open work permit at the same time. The OWP gives you the Implied Status until Stage 1 approval and they mail you the OWP. Then you're legally on a work permit until your PR is processed.
