APPLYING FOR PERMANENT RESIDENCE WITHIN CANADA: SPOUSE (LIVE IN CAREGIVER)

I hope that you can give me advice in my situation. PLEASE and THANK YOU..


I arrived here in CA last October 2012 and work as live in caregiver. My work permit will experire on September 2014. I got pregnant last May 2013 and will end my current work on December 2013.

My boyfriend and I are planning to get married this August 2013. He's a Canadian Citizen. He introduced me about APPLYING FOR PERMANENT RESIDENCE WITHIN CANADA: SPOUSE and I want to get know more about this, but its confusing!

He don't want me to work anymore as nanny after giving birth by next year 2014.

The questions are:

1. How is the process of this application if I'm under the live in caregiver program?

2. What if we apply for this and my permit will expire, what permit should I have in hand in order to stay here in Canada legally?

3. Which is more faster, applying under this application to get a PR or under the live in caregiver program?

4. Is it possible for me to apply for an open work permit if I apply under APPLYING FOR PERMANENT RESIDENCE WITHIN CANADA: SPOUSE while waiting for my PR? If yes, how? Can you give me some links to refer on?

Hi, welcome to the forum 'firsttimemom'.

You have legitimate 'status' until September 2014, so you have time to apply. Please just be aware that even though you are IN Canada, you are eligible to submit an "outland" application. This is absolutely acceptable. While an inland application would allow you to get an open work permit before you get PR, it seems you won't have an urgent need for that, which may make an 'outland' application more advisable for your case (usually quicker also).

Wow! Thanks for the quick reply. Are you in Canada when you applied in this application? If I will apply INLAND and OUTLAND that means I need to pay twice right?

If I apply INLAND, how many months will I be able to receive my OWP then? My husband don't want me to work anymore as nanny, he wants me to work somewhere that Is only for part time so I have more time to take care of our baby. So I guess I have the urgent need for OWP while waiting for PR if we will apply in this application.

No you don't, and sorry for the confusion. You must decide first which way you are going to apply, either 'inland' OR 'outland' and then just pay once for that application.

Not necessarily. Depends where you're from. In some cases inland will be faster.

But the fact that you cannot appeal an inland, is the big killer for me. Shorter wait time or not, applying outland and having the ability to appeal is very strong.

I also have the same sitaution as you, i would just like to know what did you and your husband do to apply for permanent residence within canada: spouse, Im also pregnant for 5 weeks now and a bit confuse of what im going to do. My bf also doesnt want me to go back in the philippines and very much willing to support me and sponsor me. Please, please needing best advice, I landed on May 9, 2013 in Canada. Thank you.
