Applying for H1B and EE

Hi Everyone,

Hope things are going well. I am reaching out for some help with regards to H1B and Canada PR. I am in a situation where my employer will apply for H1-B next April and I am also going to apply for Express Entry by the end of this month. I just wanted to know few things from your experience. I am currently on F-1 status.

1. Did you face any issues applying for both H1B and Canada PR in the same year. Is there anything specific to keep in mind or are they totally independent processes.

2. If I get H1-B in April ,will there be any issue with getting approval for it in case I get my Canada PR stamp before April/May. Also, did the VO at US Consulate ask any questions related to Canada PR and are there any issues with the stamping process.

3. Should I let my employer's lawyer applying for H1-B know that I have applied for Canada PR or is it not necessary

It will be very helpful to get some information on how to handle both the process correctly. Please let me know of any questions or concerns.

Both processes are completely separate and have no impact on each other. Your H1 petition has nothing to do with parallel EE application and vice versa.

I just noticed that you asked the same question in October too. Were you expecting a different answer this time?

1. No issues in applying.
2. No issues in stamping. if you are PR at that time, yes you need to mention the PR status of Canada in ds160 but its nothing to do with H1 stamping. Many in this forum are like this.
Yes, VO will ask if you are PR or visitor during stamping. Its nothing to do with stamping. Also they put annotation as Canadian PR in visa stamp - again no issues. We all have stamp like this and we enter frequently.
3. Your employer has nothing to do with PR. Dont tell them as some jealous managers/employers wont like it.
If you plan to commute:
During your move to Canada before you plan to commute, you can analyze the situation and then decide how to handle your move to Canada side. At that time you need to tell as the residence changes to other country and will be commuting daily.

Be careful about timing, once you PR is granted and a Canada permanent immigrant visa (one time entry) is stamped on your passport, you will have to land before the expiry of the visa. For me it was 6 months but basically until 1 year from the initial medical test date for the PR application. Folks call this soft landing. This means you would need a valid H1B visa to return back into USA unless you are planning to moving permanently at your first landing in Canada. You might want to research more on that.

My AOR date is July 26th, 2018 and currently I'm at IP2. I still have 28 days left for the normal 6 months processing time to be completed. I plan to call IRCC and email them after this date regarding my application. My H1-B was approved recently and my medicals are valid till July 10th, 2019.

The question I have is, what if I'm unable to do soft landing by July 10th, 2019? Will I have to start this process all over again or do I just have to get my medicals done again and that way I will get more time to do soft landing. Please advise. Thanks in advance.

Sorry not sure what happens if one skips beyond that date.

However, i do see a pattern of increased processing in late 2018 even for FSW folks. PNP and CEC used to be slow in 2017. Anyways, i wouldn't worry too much as you are in IP2 and remember it is holiday season. Mine too was delayed around late December 2017 and all was done by Jan 2018. So yeah, keep fingers crossed. And once you get your immigration visa stamped, it is just a question of 1 day formality in Canada (if time is a concern). If you need a H1B visa stamped for reentry into US after soft landing, you could schedule an appointment in american consulate in Canada and get that done in the same trip as well.
