Applying for CEC with positive LMIA in implied status - Waiting for New WP

Hi,

Is anyone is the similar situation?

- Currently in Implied Status
- Initial Work Permit expired January 2015
- Positive LMIA received February 2015
- New Work Permit requested February 2015 (processing time 3-4 months) / Same company

As we are in the implied status waiting for the new WP, we have some doubts when answering some of the questions from the Intended to Work section.

- Is XXXXXXX XXXXX currently working in Canada? Yes
- Does XXXXX XXXXX have a valid work permit for the current job in Canada? We are in implied status.
- Is XXXXX XXXXXX's job offer from the employer named on the current work permit? Again in Implied Status, the intial WP has the the name.
- Was a positive Labour Market Information Assessment (LMIA) issued for the current work permit? We have the LMIA but not a Work Permit

Do we need to wait the 3-4 month processing time for our new WP before applying for the Express Entry??

1. No you don't have a valid work permit as it has not been issued. You have to wait.

Can you please let me how long it took for LMIA to get approved. My company has applied LMIA on Feb 24th so want to know my when LMIA can be apporved with postive.

The LMIA took 45 days, requested 2nd week of Jan 15.

My counselar told me that people who on the implied status, same company and same condition, we can answer " yes" for that questions. I have been on implied status and applied for EE. I got ITA and submitted my application.

I am in the same basic situation. I'm on a NAFTA work permit. I told my company I needed a LMIA for the EE profile so I could get the 600 extra points. They filed for a LMIA, received a positive in the mail 3 weeks later and applied for the new WP. Meanwhile, I applied for EE, I put down that my current job doesn't have a LMIA and answeed yes for the job offer with a LMIA. I was awarded the extra 600 points and received an ITA in the next drawing. I'm still waiting on the new WP. The company lawyer said this was fine since I answered the questions truthfully and received the positive LMIA. I turned in my application April 15th.
