Applying for Canada tourist visa while I94 extension is under process

I am in US now on B1 visa and my validity of stay expired few weeks back and we have applied for extension on my stay till January. Application is under process.

Can i apply for Canada tourist visa while my I94 extension is under process?

you can try, but the chances are very slim. visa officer can suppose that you just want to enter Canada while your visa in the US is almost done. Canadian consulates are very tough with issuing visas.

You are eligible to apply, but like Suin said, you may have a tough time convincing them that you will abide by the immigration rules.

In other words, there is no legal barrier, but that does not guarantee issuance.

Very slim indeed considering your I94 which usually is 6 months validity has expired. You can apply but in order for your application to processed by a Canadian visa office in the US, you must have valid stay in the US (if you had not been admitted legally for a year).

I experienced this situation myself, but I was in a better situation, I had been just one month in the US on B2 visa with I94 valid for 5 more months and they refused my application twice, not believing that I will return to the US.

I experienced it too, my I94 valid for 4 more months, my ticket showing my departure date from the US... But the officer said there's no reason why I couldn't apply again from my country, which I did when I went back.

Thanks a lot for all the replies, will this apply to tourist visa or work permit as well? Just because Work Permit will is all about staying there and working from there and officer doesn't have to worry about coming back.

You would still have to apply for a TRV (worker or visitor), and there's the added requirement of having a Labor Market Opinion to go with your work permit application. And to be granted a worker visa, you must also satisfy the visa officer that you will leave Canada when your temporary work permit ends.
