Applying Canadian Univesity for MBA out of status in US

Hi,

I have a friend who is looking to apply for Canadian univerity for MBA. But he is out of status in US for about a year. Will this create any issue with the Canadian to Issues Student Visa. He has a parallel application for immigration under FSW cat 1 ( Skilled worker).

Yes, it is going to be a problem. When a person is applying for a study permit, he's not supposed to have any intention to immigrate to Canada, since a student visa and student permit only grants a temporary resident status. The consulate or embassy in the US is going to consider if he has any ties to other places other than Canada. Since he has been out of status in US for about a year, it means that he can't return to the US after his study, and he probably doesn't have sufficient ties to his home country. So, it is very risky to apply for a study permit when you're out of status, although you'll never know what's going to happen if you don't try.

I think he should probably consult a Canadian immigration lawyer.

Can't apply in the US must have "lawful" status to apply for visitor/study/work permits.
