Hi,
I want a help on the below. My wifes trv was rejected first time on ground that they were not satisfied she would return after her visa end. We had applied for around 9 months stay. In the first application we had mentioned her as a housewife although she had a job which was not that high earning.

We would like to apply second time. This time we want to show her employment history and apply with proper NOC and employment letter. Is there any issue with this. Could the visa officer charge with misrepresentation?

Not sure why you left the job off the first time. But you'd have to explain that and give a good reason why to avoid misrepresentation.
Don't apply for 9 Months...The max Is 6. But don't apply for the max. You just need to get the visa. So make it sound more like a vacation. Is her boss really going to give her 9 or 6 months off of work??? Think about it.

The point is to be honest without being too honest about your intentions. They denied her because it seemed like she was going to overstay. You basically told them that by asking for 9 months.

Thanks a lot for replying. Yes the very reason to omit employment in first case was because we were applying for her as a dependent. Realised that asking for 9 months was long. So this time we are planning to ask for 3-4 months only and show her leave and NOC. is it going to be an issue as first time we showed her as housewife. In that case what can be a good explanation?. Also does Canada doesn't have a dependent visa category for spouse. I am on work permit till next March. It seems everything is a trv

My best bet would be to claim ignorance and apologize. TBH there's no way to blatantly say I tried to deceive you in order to get through.

If you'r here on a work permit, can't she apply for a work permit instead? I'm not sure check out that section of the forum. She may have other options than TRV.

3-4 months is still a long time. You don't have to ask for the actual time the person is going to stay. As I said you just need to get the visa. You can extend your stay later one. The point is to prove your wife has a reason to go back home. Not stay here on extended periods of time.

If you are working in NOC 0, A or B you can apply for a SOWP for your wife. Applying for a temporary visa would have been refused because she isn’t a temporary visa. You should never lie on your immigration forms. You are just creating problems for yourself.

Yes i admit it was a mistake. But second time we will apply with the correct details and show her employment and leave letter. Will they check the rejected application and compare?. In that case will it be a problem? Want some insight into this

Of course they will compare to the previous applications. Your work history will keep on coming up for years.

I want suggestion. So now when i i apply for second time should i be just honest. And show her employment and attach noc and other letters. The difference between 1st application and 2nd will be that in 1st we omitted her employment but in 2nd we will show the correct details. Hope we don't het misrepresentation as the documents are completely genuine

Yes. I would apologize and hope for the best but include.

Just to clarify are you a student, PR or on a WP? If WP do you work in NOC 0, A or B? The answers will decide whether you should apply for TRV or SOWP?
