Apply SP and SOWP Together?

Hello seniors,

My wife is accepted by one of the universities in Toronto (DLI with PGWP eligible)- Winter Intake. We are planning to apply for (SP + SOWP) Student Permit and Spousal Open Work Permit together. I have seen a few successes and a lot of rejection cases being discussed on this forum where the spouse of international students is not guaranteed open work permit. I understand the rejection ratio is pretty high and wanted to seek suggestions on moving forward with the application.

Info about us -
Wife will be a student, I am willing to accompany her on SOWP
We are applying from India.
3+ years of marriage and know each other for the past 5 years have all the docs/chats to prove that marriage is genuine

My questions are as follows -

1)Outcome - If applied together SP + SOWP and SOWP gets rejected, how will the outcome be of the final decision - will SP also get rejected? or SP and SOWP are issued separately and will not impact the overall application.
2) Funds - I am planning to get GIC of $14200 CAD, Bank (joint account where student is primary member) account balance of appx 9-10 Lakh INR ~ $16-18K CAD. Will this be sufficient?
3) Spouse profile Impact - I am working in IT as a cloud solution architect with few good certifications, the role is something which in demand in the Canadian job market and attracts a median pay of 100K CAD easily. Will the job profile make any impact on the application decision?
4) Location - I will be applying from India where there are a lot of fraudulent cases especially in the north India region, will the location play any role in the application decision?

1. You can still receive a study permit if your spousal work permit application is refused, but applying for the work permit at the same time as the study permit reduces your ties to your home country, which can contribute to a refusal.

2. You need to show proof you can afford your tuition + $14,000 in living expenses.

3. Yes, if you've applied for a college course that doesn't seem relevant to your professional background and future prospects in India. You can't look like you want to immigrate permanently with your family on a study permit as it is only a temporary status.

4. Applicants from countries like India are often more heavily scrutinized, but if you meet the eligibility and admissibility requirements your application will be approved no matter what country you are from.

1. I applied together with my spouse and send an inquiry about our case with such question to an officer. In short, both applications are processed together and depend upon principal applicant approval even though they split in two once submitted (which is SP holder usually)
2. For that your best bet to refer to IRCC website and/or ask those on the forum who applied from India along with their family. I just showed an amount equal to tuition fees + 10K CAD + 4K CAD and I think about 20K CAD more (I said an approximate amount since I showed my funds mostly in USD)
3. I struggle to understand whether you are a spouse or a student (but most likely a spouse). Are you planning to work remotely or find employment in Canada? What matters mostly is whether you guys are going to overstay or not. Employment should not play a significant role (maybe). My spouse said that he is going to work remotely and proved that he has enough income to support me and that his business can work well without his physical presence. However, my main sponsor is my parent (I am 22 and finishing bachelors). In short, funds play a role more than employment.
4. What matters most is that you are applying from country of residence, that is a plus for home ties. As long as you are not going to falsify documents and SP is a genuine student, you should be fine

But when you mentioned that your spouse is staying at your home country and use him/her as a family tie in your application, the VO will look at your application when your spouse apply for the visa later. I know some people who got rejected because they lied at first place.

On one hand where @primaprime has said that SP can be granted while OPW is rejected.
You can still receive a study permit if your spousal work permit application is refused, but applying for the work permit at the same time as the study permit reduces your ties to your home country, which can contribute to a refusal.
On the other hand, @janesama is a first hand applicant who has applied with Spouse and has mentioned that it will be accepted all or rejected all. there is no middle ground. [Correct me if I am wrong].

I am back to square 1, it's really contradicting whether SP is granted or not.
From my direct interaction with IRCC, I can only say that I’m correct. You can raise a webform and ask your local IRCC branch this same question, they might help (If they are not too busy, they will reply to your inquiry)
Another way is to either wait for more people to respond from their own experience, Google the answer for your question, or research this very forum

Hi @Adityaintouch , Finally how did you apply ? Together or Separate ? Did you'll get the SP and SOWP?
Even am on the same track as you were.
