Apply PR in Canada and take up rest from india

Hi,

I have been working in Canada for more than 12 months and I am stated to travel back to India in a month’s time. I would like to know if I can apply for my PR in Canada and take up rest of the PR processing from India.

I am looking to apply under Federal skilled worker as the new rules are favourable.

Please advice.

If you are on the list of 38, you can apply as an FSW and doesn't matter if you apply in Canada or in India. If you are not on the list of 38, you can get in through the category of having lived legally in Canada for 1 year but then you have to apply before you leave.

The OP has only one year of work and s/he doesn't mention any studying. To apply under the CEC class requires 2 years of skilled work in Canada.

"Work experience as a Temporary Foreign Worker

You must have obtained the equivalent of two years of recent full-time or full-time equivalent (one week is 37.5 hours of work) Canadian skilled work experience at NOC Skill Type 0, or Skill Level A or B. This work experience must have been acquired in Canada (within the three years preceding the date the application is made*).

You do not have to be employed at the time of the application.

Note: Any periods of self-employment or unauthorized work cannot be included when calculating the period of work experience. You must have temporary status during the period of work experience."

Hi,

Yes, I am looking to apply thru FSW – Category 1.

My question is since I am stated to travel back to India can I mention my Indian mailing address in the application.

Also do all FSW – category 1 applications have to be sent to Sydney, Nova Scotia or should I send it to my new Delhi, India.

If you are applying as 1 of the 38 occupations, you send your application to Sydney and tell them you wish to process your application in India. It's only if you are applying as within Canada that you have to apply while you are still in Canada. If you are 1 of the 38, you can apply whenever.

As have been working in Canada for more than 12 months as a computer programmer, I am eligible to apply in both category 1 and category 3.

category 1
you are in an occupation which corresponds to the list of occupations identified in the Ministerial Instructions and have evidence of one year of continuous full-time (or full-time equivalent) experience in that occupation

category 3
you are a student or worker who is legally residing in Canada, and have done so for at least 12 months immediately before submitting your application


Which category should I apply in? Which option would be best?

Note that is says: "Applicants with experience in the following occupations may also be considered under this NOC depending on the specifics of the main duties performed:"

You have to look for 0213 Computer and Information Systems Managers in the NOC. If your job duties fit that, then you can apply under that.
