Apply outland and then move early?

Can I a Canadian Citizen and my husband an Australian citizen apply outland from Australia and then move to Canada before any decisions are made? We are thinking of applying now and then moving to Canada in September and waiting for a decision there. Is this allowed does anyone know? And anyone have experience with the Sydney office?

Yes you can but by applying while outside Canada you must include proof that you intend to settle in Canada.

Yes, you can do this. Technically, your husband cannot move to Canada until he is a PR; he would be coming as a visitor. When he enters, he shouldn't say that he is moving to or coming to live in Canada. He is visiting his spouse while the PR app processes.

I would love to do this with my wife when the lease on her apartment comes up at the end of October since we likely won't have a decision made by then, but I'm not sure how she would go about maintaining proper ties to her home country.

Even if we put her things in storage and she moved her home address to a friend's place, visiting me for anything more than a short vacation would mean quitting her job because she only gets three weeks vacation. If she were to come and visit for several months, we'd have a hard time proving she has sufficient ties to her home country, wouldn't we?

It's similar to the situation we ran into before we were able to get married. CIC told us we should be living common law, but no one could tell us how she's supposed to live with me for a year while maintain legitimate ties to her home country -- it's not like she could leave her job and I could afford to pay for our house in Canada as well as her apartment in her home country. The whole thing baffles me.

When we entered halfway through the process, my partner had no home country ties, no job, no lease, closed the bank accounts etc. We pretty much told the officer that my partner was moving to Canada for good, as his PR app would be approved soon. The officer never asked for any proof of home country ties. He didn't ask to see a return ticket (which we had) or proof of funds (he just asked how much we had). He verified we had an app in process, told my partner not to work until PR and sent us on our way.

Once a PR app is submitted, they are pretty lenient on the "home country ties" aspect.

Every case is difference. In my case, my wife (non-visa exempt) was with me in the car when we drove back to Canada. We had no return ticket for my wife, no ties to her home country only had just our luggage. I told the border that we were moving back to Canada and will be submitting an PR application once we are in Canada. They gave us no hassle at all. Just processed my wife's visa for 6 months and away we went. The border agent even told us to submit a visitor extension for 12 months with the PR application together.
